About some questions of implementation of obligatory civil liability insurance of owners of vehicles

According to Article 7, to Item 9.5 of Article 9, of Article 11, of Item 49.2 of Article 49, of article 55 of the Law of Ukraine "About compulsory insurance of civil responsibility of owners of land vehicles", Articles 28, 34 Laws of Ukraine "About financial services and state regulation of the markets of financial services", to requirements of the subitem 11 of item 4 of the Regulations on State commission for regulation of the markets of financial services of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of February 3, 2010 No. 157, and for the purpose of enhancement of state regulation of activities for provision of insurance services in obligatory civil liability insurance of owners of vehicles State commission on regulation of the markets of financial services of Ukraine DECIDED:

1. Establish the sizes of insurance sums under the agreements of compulsory insurance of civil responsibility of owners of land vehicles signed after entry into force of this order:

for the harm done to property of the victims in the amount of 130000 hryvnias on one victim;

for the harm done to life and health of the victims in the amount of 260000 hryvnias on one victim.

2. Approve basic insurance payment under agreements of compulsory insurance of civil responsibility of owners of land vehicles on representation of Motor (transport) insurance bureau of Ukraine in the amount of 180 UAH and Adjusting factors and their sizes which are applied.

3. Actually ceased to be valid according to the Order of the National commission performing state regulation in the field of the markets of financial services of Ukraine of 04.04.2017 No. 868.

5. Approve Regulations on the single centralized database on obligatory civil liability insurance of owners of vehicles which are applied.

6. Department of standards of regulation and supervision of financial institutions together with department of prudential supervision, department of registration, licensing and allowing procedures, legal support division to submit this order to the Ministry of Justice of Ukraine for state registration.

7. Declare invalid the order of State commission on regulation of the markets of financial services of Ukraine of December 16, 2004 No. 3099 "About approval of basic insurance payment under agreements of compulsory insurance of civil responsibility of owners of land vehicles", registered in the Ministry of Justice of Ukraine on December 21, 2004 for No. 1619/10218.

8. Department of public relations and the protocol to provide placement of this order on the official site of State commission on regulation of the markets of financial services of Ukraine on the Internet after its state registration.

9. This order becomes effective in 10 days after its state registration.

10. Control over the implementation of this order to assign to the First Deputy Chairman compliance with distribution of obligations.

Regulations on the single centralized database of rather compulsory insurance of civil responsibility of owners of land vehicles

I. General provisions

1.1. This Provision is developed according to articles 11 and 55 of the Law of Ukraine "About compulsory insurance of civil responsibility of owners of land vehicles" (farther the Law).

1.2. The purpose of creation of the single centralized database of Motor (transport) insurance bureau of Ukraine (further - MTSBU) rather compulsory insurance of civil responsibility of owners of land vehicles is accumulating of data on the existing and stopped agreements of compulsory insurance of civil responsibility of owners of land vehicles (further - compulsory insurance of civil responsibility), insured events which took place, vehicles and their owners for the organization of exchange of information about compulsory insurance of civil responsibility and control of its implementation.

1.3. In this Provision terms are used in such values:

the MTSBU database - the MTSBU single centralized database of rather compulsory insurance of civil responsibility of owners of land vehicles;

identification data set - the minimum set of details in which data are sufficient for their identification in the MTSBU database;

identification of data - verification of data on availability in them of the details containing unique, correct and complete codes which provide originality of such data within the MTSBU database;

users of open information of the MTSBU database are insurers - members MTSBU, public authorities, the companies, organizations, the organizations, citizens;

users of information with limited access to the MTSBU database are insurers - members of MTSBU and insurers (regarding information on prisoners such insurers and insurers of agreements of compulsory insurance of civil responsibility) MTSBU, public authorities;

obligatory data set - set of details and data which are sufficient for forming of obligatory and standard reports of the MTSBU database;

the operator of the single centralized database (further - the Operator) - MTSBU which provides creation, maintaining, material and technological support of the single centralized database, safety and information security containing in it;

full range of data - set of the details and data which are sufficient for accomplishment of all available functions of search, the analysis, forming of forms and reports in the MTSBU database;

suppliers of information in the MTSBU database are insurers - members of MTSBU, MTSBU, state bodies in the field of traffic safety;

the software of the insurer - set of the software and systems of information processing of the insurer intended for accomplishment by the insurer - the member of MTSBU of tasks on forming and transfer of data in the MTSBU database, including internal electronic insurance contracts, necessary for the conclusion;

centralized reference books - the classified and codified data which values and codes are single for all users of the MTSBU database and for all records of the MTSBU database.

Other terms in this Provision are used in values according to the Laws of Ukraine "About compulsory insurance of civil responsibility of owners of land vehicles" (further - the Law), "About information", "About electronic commerce", "About information security in information and telecommunication systems".

1.4. The main functions of the single centralized database is:

accumulating of information on the existing and stopped agreements of compulsory insurance of civil responsibility, insured events which took place, vehicles and their owners;

accumulating of information concerning indicators of activities for compulsory insurance of civil responsibility of owners of land vehicles;

provision of open information for free and public use;

provision of information of limited access to insurers to members of MTSBU, and also public authorities according to their competence established by the law.

II. The list of information which is provided without fail by insurers, other persons for forming of information resources of the MTSBU database

2.1. Insurers - members of MTSBU without fail perform collection and delivery to the MTSBU database of such information on the form established by appendix to this Provision:

2.1.1. Data on the lost, damaged and destroyed forms of policies of compulsory insurance of civil responsibility of owners of land vehicles.

2.1.2. Data on the signed and ahead of schedule stopped internal agreements of compulsory insurance of civil responsibility of owners of land vehicles.
