Article 1. Purpose of this Federal Law

The purpose of this Federal Law is establishment of the general principles of the organization, activities and the main powers of control and calculating bodies of subjects of the Russian Federation, control and calculating bodies of the federal territories and control and calculating bodies of municipalities (further also - control and calculating bodies).

Article 2. Legal regulation of the organization and activities of control and calculating bodies

1. Legal regulation of the organization and activities of control and calculating bodies of subjects of the Russian Federation is based on the Constitution of the Russian Federation and No. 414-FZ "About the general principles of the organization of the public power in subjects of the Russian Federation", the Budget code of the Russian Federation, this Federal Law, other Federal Laws and other regulatory legal acts of the Russian Federation, the constitution (charter), the laws and other regulatory legal acts of subjects of the Russian Federation is performed by the Federal Law of December 21, 2021.

1.1. Legal regulation of the organization and activities of control and calculating bodies of the federal territories is based on the Constitution of the Russian Federation and is performed by the Federal Law on the corresponding federal territory, the Budget code of the Russian Federation, this Federal Law, other Federal Laws and other regulatory legal acts of the Russian Federation, charters of the federal territories, regulatory legal acts of representative bodies of the federal territories.

2. Legal regulation of the organization and activities of control and calculating bodies of municipalities is based on the Constitution of the Russian Federation and No. 131-FZ "About the general principles of the organization of local self-government in the Russian Federation", the Budget code of the Russian Federation, this Federal Law, other Federal Laws and other regulatory legal acts of the Russian Federation, municipal regulatory legal acts is performed by the Federal Law of October 6, 2003. In the cases and procedure established by the Federal Laws, legal regulation of the organization and activities of control and calculating bodies of municipalities is performed also by the laws of the subject of the Russian Federation.

3. The Federal Laws and other regulatory legal acts of the Russian Federation, the laws and regulatory legal acts of subjects of the Russian Federation, regulatory legal acts of representative bodies of the federal territories, municipal regulatory legal acts regulating questions of the organization and activities of control and calculating bodies shall not contradict the Budget code of the Russian Federation and this Federal Law.

Article 3. Bases of the status of control and calculating bodies

1. The control and calculating body of the subject of the Russian Federation is permanent body of external state financial control and is formed by legislature of the subject of the Russian Federation.

1.1. The control and calculating body of the federal territory is permanent state body of external state and municipal financial control and is formed by representative body of the federal territory.

2. The control and calculating body of the municipality is permanent body of external municipal financial control and is formed by representative body of the municipality.

3. The control and calculating body of the subject of the Russian Federation, control and calculating body of the federal territory, control and calculating body of the municipality are accountable according to legislature of the subject of the Russian Federation, representative body of the federal territory, representative body of the municipality (further also - legislative (representative) bodies).

4. Control and calculating bodies have organizational and functional independence and perform the activities independently.

5. Activities of control and calculating bodies cannot be suspended, including in connection with early termination of powers of legislative (representative) body.

6. Names, powers, structure and procedure for activities of control and calculating body of the subject of the Russian Federation, control and calculating body of the federal territory, control and calculating body of the municipality are established respectively by the constitution (charter) and (or) the law of the subject of the Russian Federation, the charter of the federal territory and (or) regulatory legal act of representative body of the federal territory, the charter of the municipality and (or) regulatory legal act of representative body of the municipality according to this Federal Law.

7. The control and calculating body of the subject of the Russian Federation and control and calculating body of the federal territory have rights of the legal entity.

8. The control and calculating body of the municipality allocated with the status of the municipal district, municipal district, city district or city district with intracity division has rights of the legal entity. The control and calculating body of the municipality allocated with other status can have rights of the legal entity according to the charter of the municipality.

9. Control and calculating bodies have official stamp and forms with the name and with the image of the coat of arms of the subject of the Russian Federation, the federal territory or the municipality.

10. The organization and activities of control and calculating body of the intracity municipality of the federal cities are determined by the law of the subject of the Russian Federation - the federal cities.

11. Representative bodies of the settlements which are part of the municipal district having the right to sign agreements with representative body of the municipal district on transfer control calculating to body of the municipal district of powers of control and calculating body of the settlement for implementation of external municipal financial control.

12. According to the procedure, determined by the laws of subjects of the Russian Federation, representative bodies of municipalities have the right to sign agreements with control and calculating bodies of subjects of the Russian Federation on transfer of powers to them on implementation of external municipal financial control.
