About approval of the Regulations on warehouses of temporary storage

According to the Special application And to the International convention about simplification and harmonization of customs procedures of May 18, 1973, Chapter 63 of the Customs code of Ukraine, the subitem 64 of item 4 and the subitem 3 of Item 10 of the Regulations on the Ministry of Finance of Ukraine approved by the Presidential decree of Ukraine of April 08, 2011 No. 446, I ORDER:

1. Approve Regulations on warehouses of temporary storage which are applied.

2. Recognize invalid orders GFS:

of October 07, 2003 No. 674 "About approval of the Regulations on warehouses of temporary storage", registered in the Ministry of Justice of Ukraine on November 19, 2003 for No. 1061/8382;

of March 15, 2004 No. 189 "About modification and amendments in Regulations on warehouses of temporary storage", registered in the Ministry of Justice of Ukraine on March 26, 2004 for No. 373/8972;

of December 07, 2006 No. 1088 "About introduction of amendments to some orders of State Customs Service", registered in the Ministry of Justice of Ukraine on December 21 in 2006 for No. 1339/13213;

of May 13, 2009 No. 443 "About approval of the Procedure for accounting and representation of the reporting to customs authorities concerning goods in warehouses of temporary storage", registered in the Ministry of Justice of Ukraine on May 29, 2009 for No. 471/16487.

3. (Chmeruk M. O.) and to Department of the organization of customs control and registration of GFS (Syomk S. M.) in accordance with the established procedure to provide to department of tax, customs policy and methodology of financial accounting of the Ministry of Finance of Ukraine:

submission of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

4. This order becomes effective from the date of entry into force of the Customs code of Ukraine of March 13, 2012, but not earlier than day of official publication.

5. To impose control over the implementation of this order on the First Deputy Minister of Finance of Ukraine Myarkovsky A. I. and First Deputy Chairman of the State Customs Service of Ukraine of Dorokhovsky O. M.

Regulations on warehouses of temporary storage

І. General provisions

1.1. This Provision determines form, procedure for representation and consideration of the applications, procedure for provision, stop of action, cancellation of permission to opening and operation of warehouse of temporary storage (further - SVH); requirements to warehouse objects which can be used as SVH; rules of implementation of activities of SVH and procedure for control of their implementation; procedure for placement, storage and accounting of goods, vehicles of commercial appointment to SVH.

1.2. In this Provision terms are used in such value:

the open area - specially equipped and protected territory intended for storage of goods and located outside the boundaries of rooms;

the covered platform the territory - covered, specially equipped and protected adapted for storage of goods and located outside the boundaries of rooms;

the freezer - the building or the device for freezing and storage of food and other perishable products at temperature from -1 °C to -35 °C;

system of electronic accounting of goods on SVH - the program and information complex of the holder of SVH constructed with use of database management system, intended for accounting of goods and vehicles which take place, stored and exported from SVH;
