According to subitem 7.40 of the subitem 7 of item 4 of the Regulations on the Ministry of Agricultural Policy and Food of Ukraine approved by the Presidential decree of Ukraine of April 23, 2011 No. 500, I ORDER:

1. Approve the Procedure for normative money value of lands for nonagricultural appointment (except lands of settlements) which is applied.

2. To department of agriculture (Demidov O. A.) provide provision of this order on state registration in the Ministry of Justice of Ukraine.

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the deputy minister Davidenko V. M.

Procedure for normative money value of lands for nonagricultural appointment (except lands of settlements)

І. General provisions

1.1. This Procedure determines the procedure of carrying out normative money value of lands of nonagricultural appointment (except lands of settlements).

1.2. The normative money value of lands of nonagricultural appointment (except lands of settlements) is carried out according to the Technique of the normative money value of lands of nonagricultural appointment (except lands of settlements) approved by the resolution of the Cabinet of Ministers of Ukraine of November 23, 2011 No. 1278.

1.3. No. 604 is excluded according to the Order of the Ministry of Agricultural Policy and Food of Ukraine of 18.12.2018.

ІІ. Normative money value of the parcel of land

2.1. The normative money value of the parcel of land (Цн) is determined by formula

Цн = Pd x Rd x Sk x Km x KV x Kmts x Ki

where

Пд - the area of the parcel of land which is accepted according to the State land cadastre or documentation on land management, sq.m;

Рд - investment income on one sq.m of the area for the corresponding category of lands which is determined by standard rates of investment income for the corresponding category of lands according to appendix 1 to this Procedure, hryvnias a year;

Ск - the capitalization term which is determined according to Item 2.2 of this Section, years;

Km - the coefficient considering the location of lands which is determined according to Item 2.3 of this Section;

KV - the coefficient considering type of use of the parcel of land which is determined according to Item 2.7 of this Section;

Kmts - the coefficient considering belonging of the parcel of land to lands of nature protection, improving, recreational, historical and cultural appointment which is determined according to Item 2.12 of this Section;

Ki - coefficient of indexation of normative money value of lands which is determined according to Article 289 of the Section XIII of the Tax code of Ukraine.

2.2. The term of capitalization of investment income is determined for all categories of lands (except lands of forestry and landscape appointment) and constitutes 33 years, for lands of forestry and landscape appointment - 50 years.

2.3. The coefficient which considers the location of lands (Km) (except lands of forestry and landscape appointment and lands of water fund) is determined for cadastral quarter which limits are displayed on index cadastral maps (plans), on formula

Km = KR x C,

  where

The KR - the coefficient considering regional factors of the location of cadastral quarter which is determined according to Item 2.4 of this Section;

C - the coefficient considering local factors of the location of cadastral quarter on territorial planning, engineering-geological, historical and cultural, natural and landscape, sanitary and hygienic and to other conditions that is determined according to Item 2.6 of this Section.

For lands of forestry and landscape appointment and lands of water fund the coefficient considering the location of lands (Km) is accepted equal to unit.

2.4. The coefficient considering regional factors of the location of cadastral quarter (KR) is determined by formula

KR = Kr1 x Kr2 x Kr3

where

Kr1 - the coefficient considering remoteness of cadastral quarter from settlements that is determined according to Item 2.5 of this Section;

Kr2 - the coefficient considering remoteness of cadastral quarter from highways of the state value is also determined according to appendix 2 to this Procedure;

Kr3 - the coefficient considering arrangement of cadastral quarter in zones of radioactive pollution as a result of the Chernobyl catastrophic crash is also determined according to appendix 3 to this Procedure.

2.5. The coefficient considering remoteness of cadastral quarter from settlements (The KR 1) which normative money value of lands is determined if the smallest distance from border of cadastral quarter to border of the settlement does not exceed zone of influence of the settlement (D) for the corresponding category of lands is determined by formula (except lands of natural and reserved and other nature protection appointment, improving appointment, historical and cultural appointment, forestry and landscape appointment, water fund)

Tsnm - the average cost of one square meter of lands of the settlement depending on regional factors of the location determined according to the Procedure for normative money value of lands for agricultural purpose and settlements approved by the order of the State committee of Ukraine on land resources, the Ministries of agrarian policy of Ukraine, the Ministry of Construction, Architecture and Housing of Ukraine, the Ukrainian academy of agrarian sciences of January 27, 2006 No. 18/15/21/11, registered in the Ministry of Justice of Ukraine on April 05, 2006 for No. 388/12262, taking into account coefficient of indexation of normative money value of lands, hryvnias;

Кпт - the coefficient considering degree of town-planning value of the territories in zone of influence of settlements is also determined according to appendix 4 to this Procedure;

Ск - the capitalization term (33 years);

Рд - investment income on one sq.m of the area for the corresponding category of lands (except lands of natural and reserved and other nature protection appointment, improving appointment, historical and cultural appointment, forestry and landscape appointment, water fund) which is determined by standard rates of investment income for the corresponding category of lands according to appendix 1 to this Procedure, hryvnias a year;

Kr2 - the coefficient considering remoteness of cadastral quarter from highways of the state value is also determined according to appendix 2 to this Procedure;

Kr3 - the coefficient considering arrangement of cadastral quarter in zones of radioactive pollution as a result of the Chernobyl catastrophic crash is also determined according to appendix 3 to this Procedure;

Д - width of zone of influence of the settlement which is determined according to appendix 5 to this Procedure, km;

L - geometrically the smallest distance from border of cadastral quarter to settlement border according to data of index cadastral maps (plans), km.

If settlements which normative money value of lands is determined are absent at distance from border of cadastral quarter less, than width of zone of influence of settlements (D), coefficient of Kr1 is accepted equal to unit.

For lands of natural and reserved and other nature protection appointment, improving appointment, historical and cultural appointment, forestry and landscape appointment, water fund the coefficient of Kr1 is accepted equal to unit.

If cadastral quarter is located within width of zone of influence of several settlements, the greatest of possible values of coefficient Kr1 is accepted.

If the calculated value of coefficient of Kr1 is less than unit, it is accepted equal to unit.

2.6. The coefficient considering local factors of the location of cadastral quarter on territorial and planning, engineering-geological, historical and cultural, natural and landscape, sanitary and hygienic and other conditions (C) is determined according to appendix 6 to this Procedure as the work of values of coefficients which correspond to the local factors which are shown within this cadastral quarter.

2.7. The coefficient considering type of use of the parcel of land (KV) is determined by formula

KV = Kv1 x Kv2 x Kv3 x Kv4

where

Kv1 - the coefficient considering structure of grounds of the parcel of land is determined according to appendix 7 to this Procedure according to data of the State land cadastre;

Kv2 - the coefficient considering regional differences in forming of investment income and which is determined for lands of the industry, transport, communication, power, defense and other appointment according to appendix 8 to this Procedure, and for the parcels of land of other categories is equated to unit;

Kv3 - the coefficient considering performance of forest plantings and which is determined for the lands covered forest (wood and shrubby) vegetation, according to Items 2. 8, 2.9 and 2.10 these Sections, and for other land grounds are equated to unit;

Kv4 - the coefficient considering performance of water objects and which is determined for lands with these objects: natural waterways (the rivers and streams), artificial waterways (channels), lakes, ponds, water storage basins and other water objects, according to Item 2.11 of this Section, and for other land grounds it is equated to unit.
