RESOLUTION OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN

of June 28, 2003 No. 290

About enhancement of the organization of activities of the Ministry of agricultural and water economy of the Republic of Uzbekistan

(as amended on 15-01-2019)

In pursuance of the Presidential decree of the Republic of Uzbekistan of March 24, 2003 and for the purpose of radical enhancement of management system agricultural production according to requirements of market economy the Cabinet of Ministers decides No. UP-3226 "About the Most Important Directions of Deepening of Reforms in Agricultural Industry":

1. Approve:

organizational structure of the Ministry of agricultural and water economy of the Republic of Uzbekistan and the list of the organizations and companies which coordination of activities is performed by the Ministry of agricultural and water economy of the Republic of Uzbekistan, according to appendices No. 1 and 2 ;

structure of the office of the Ministry of agricultural and water economy of the Republic of Karakalpakstan, standard structure of the office of regional management of agricultural and water economy according to appendices No. No. 4 and 4a;

structure and extreme number of workers of the office of district departments of agricultural and water economy of categories according to appendix No. 4b;

Regulations on the Ministry of agricultural and water economy of the Republic of Uzbekistan according to appendix No. 5;

standard regulations on regional management and district department of agricultural and water economy according to appendices No. No. 6 and 6a.

2. Determine that in the Ministry of agricultural and water economy of the Republic of Uzbekistan the board in number of 15 people is formed. Chairmen of Councils for the problem resolution of development of the leading industries and spheres of agricultural industry are part of board. The staff of board affirms the Cabinet of Ministers of the Republic of Uzbekistan.

3. Determine that the Ministry of agricultural and water economy of the Republic of Uzbekistan performs coordination of activities of the servicing, procurement and processing enterprises and the organizations of the republic regarding the organization of their relations with agricultural producers.

4. Assign ensuring control of observance by farms of recommendations about sortorazmeshcheniye of cotton and grain crops to the Ministry of agricultural and water economy of the Republic of Karakalpakstan, regional managements of agricultural and water economy.

5. Determine that:

The ministry of agricultural and water economy of the Republic of Karakalpakstan, regional managements and district departments of agricultural and water economy are subordinated and accountable according to Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas, areas and the Ministry of agricultural and water economy of the Republic of Uzbekistan;

appointment of the minister of agricultural and water economy of the Republic of Karakalpakstan is performed by the Jokargi Kenes of the Republic of Karakalpakstan in coordination with the minister of agricultural and water economy of the Republic of Uzbekistan;

appointment of heads of regional managements of agricultural and water economy is performed by the minister of agricultural and water economy of the Republic of Uzbekistan of representation of hokim of areas;

appointment of heads of district departments of agricultural and water economy is performed by the minister of agricultural and water economy of the Republic of Karakalpakstan and chiefs of regional managements of agricultural and water economy of representation of hokim of areas.

6. Grant the right to khokimiyats of areas in coordination with regional managements of agricultural and water economy, proceeding from the number of workers (appendix No. 4b) approved by limiting this resolution and agricultural specialization of areas, establish the specific number and the staff list of workers of the office of district departments of agricultural and water economy in strict accordance with the established single scale of charges for rural districts of 1st, 2nd and 3rd categories.

7. Accept the offer of the Ministry of agricultural and water economy of the Republic of Uzbekistan, and also founders of the relevant associations, the organizations and the companies about liquidation, reorganization and removal from structure of the Ministry of agricultural and water economy of the organizations and the companies according to appendix No. 7.

To provide to the ministry of agricultural and water economy of the Republic of Uzbekistan together with the Ministry of Justice, the State committee on demonopolization and development of the competition and the State Property Committee of the Republic of Uzbekistan in two-month time in accordance with the established procedure liquidation, reorganization of the companies and organizations specified in appendix No. 7 to this resolution and to introduce to the Cabinet of Ministers drafts of government decisions on entering of corresponding changes and amendments into the legislation.

Determine that training of the cattle breeders studying at Republican school of the best practices and at Republican school of the gardeners accepted for study since 2008 is performed by extrabudgetary funds.

8. To the State Property Committee together with the Ministry of agricultural and water economy of the Republic of Uzbekistan in connection with liquidation, reorganization and conclusion from structure of the Ministry of agricultural and water economy of the Republic of Uzbekistan of the economic associations, the organizations and the companies specified in appendix No. 7 to this resolution to make in the Cabinet of Ministers offers on effective use of the released buildings, constructions and other property, and also further privatization of the state companies of the republican organizations and territorial subdivisions of the Ministry of agricultural and water economy of the Republic of Uzbekistan in a month.

9. Recognize invalid separate decisions of the Government of the Republic of Uzbekistan according to appendix No. 8.

10. To impose control over the implementation of this resolution on the Prime Minister of the Republic of Uzbekistan U. T. Sultanov and the counselor of state of the President of the Republic of Uzbekistan I. H. Dzhurabekov.

Regulations on the Ministry of agricultural and water economy of the Republic of Uzbekistan

I. General provisions

1. This Provision determines tasks, functions, powers and organizational bases of activities of the Ministry of agricultural and water economy of the Republic of Uzbekistan (further - the Ministry).

2. The ministry in the activities is guided by the Constitution of the Republic of Uzbekistan, the laws of the Republic of Uzbekistan, resolutions and other decisions of Oliy Majlis of the Republic of Uzbekistan, decrees and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers of the Republic of Uzbekistan and other acts of the legislation, and also this Provision.

3. The ministry in the activities is accountable to the Cabinet of Ministers of the Republic of Uzbekistan.

4. The ministry performs coordination in the field of agricultural and water economy, solves the problems assigned to it and functions is direct, and also through republican and territorial authorities subordinated to it.

5. The ministry is legal entity, has seal with the image of the State Emblem of the Republic of Uzbekistan and with the name, accounts in organizations of bank.

II. Tasks and functions of the Ministry

6. Tasks of the Ministry are:

carrying out the single agrotechnical policy directed to upgrade and sustainable development of agricultural industry;

enhancement and implementation of modern agrotechnologies in the field of agricultural production;

coordination of activities of the industries, links and structures servicing agricultural producers on the basis of the market principles and mechanisms;

coordination of works on deepening of economic reforms in the agrarian sector, to broad development of the rent relations, family contract, farms;

development of recommendations about enhancement of system of farming and to sortorazmeshcheniye of crops;

carrying out state policy in the field of selection and seed farming, breeding case and safety of products of livestock production, poultry farming and fish breeding;

implementation of public administration by superficial water resources on the basis of the basin principle of management of irrigational systems and implementation at all levels of the market principles of water use and water consumption;

ensuring operation and upgrade of the state water management system;

implementation of the measures for improvement of meliorative condition which are old irrigated and to development of new lands;

participation in development of investment policy in agricultural and water economy;

ensuring strict observance of the legislation on use of land and water resources;

scientific and technical and information support of the subordinated organizations and companies;

training, retraining and advanced training of heads and specialists of bodies of agricultural and water economy;

7. According to the assigned tasks the Ministry performs the following functions:

makes in the Cabinet of Ministers offers on the main directions of state policy in the field of agricultural and water economy, strategy and to the mechanism of their realization;

develops industry and regional development programs of agricultural and water economy;

conducts marketing researches of market situation of agricultural products, provides with necessary information of agricultural producers;

participates in attraction of external and domestic investments into rural and water farms, provides rational and target use of budgetary funds;

develops methodical recommendations about implementation of productive and financial and economic activity by the companies of agricultural and water economy;

coordinates work of specialized subordinated elite and seed-growing farms on strain testing, removal and reproduction of new perspective grades of crops;

makes in the Cabinet of Ministers suggestions for improvement of relations of production and labor organization in industry;

determines the main directions and coordinates carrying out selection and breeding work;

develops balance of water resources, sets limits of water intakes of sources, basin irrigational systems, economy industries, the territories;

provides realization of procedure on the limited water use and water consumption;

performs the methodical and practical help in the organization and development of associations and other associations of water consumers;

exercises control of superficial water resources on the basis of the basin principle;

develops and implements the principles of market relations and economic mechanisms in use of water resources;

develops programs for meliorative improvement and land development;

will organize implementation of operation of channels and collectors, water storage basins, pumping points, hydraulic engineering constructions and other state water management objects;

coordinates work on technical operation, reconstruction and repair of water management objects of associations of water consumers;

will organize accounting and control of use of water resources, participates in maintaining the state water inventory according to the Section "Use of Waters";

performs monitoring of meliorative condition of the irrigated lands, quality of irrigating and collector and drainage waters;

issues permission to special water use or water consumption to the basin managements of irrigational systems, managements of the main channels (systems), managements of operation of water storage basins, the organizations operating cross-border water objects, water objects of interregional value, large and especially important water management objects, to managements of pumping points, power and communication, meliorative expeditions and also other water users and water consumers - from artificial water objects of republican or interregional value, makes offers in bodies on on ecology and environmental protection about issue of permission to special water use and water consumption from natural superficial water objects;

develops perspective schemes of complex use of water resources;

makes offers on management and use of transboundary water resources and objects in the Cabinet of Ministers;

participates in development of the strategy of development for production and social infrastructure of the village;

determines the main directions, will organize and coordinates research, design and survey and design works in the field of agricultural and water economy, promotes implementation of their results in practice;

makes in the Cabinet of Ministers offers on the priority directions of international cooperation in the field of agricultural and water economy;

will organize advanced training and experience exchange of heads and specialists shirkatny and farms in educational institutions and scientific institutions of the republic, and also abroad.

8. The ministry creates necessary conditions for the effective organization of activities of Councils for the problem resolution:

developments of cotton growing;

grain-growing developments;

development and complex conversion of ovoshchebakhchevy cultures, fruits and grapes;

developments of livestock production;

rational use of land and water resources, development of irrigation and increase in fertility of lands;

mechanization and chemicalixation of agricultural industry.

III. Rights of the Ministry

9. The ministry has the following rights:

request and receive in accordance with the established procedure from state governing bodies, organizations and the organizations the materials necessary for the solution of the questions entering its competence;

draw the conclusions on the drafts of decisions and offers on use of land, water and forest resources submitted to it for approval;

impose import ban on the republic territory physical persons and legal entities of the cattle and products of livestock production from adverse regions of the world, and also products of crop production and seeds in the epizootic relation;

adjust limits of water intakes in case of change of water content of sources;

make decisions on the termination of water giving in case of superlimit water intake and ownerless, irrational use of water resources;

apply, according to the legislation, responsibility measures to officials and citizens for violation of the water legislation, procedure for water use and water consumption;

organize economic incentives of water users and water consumers for rational management and economical use of water resources;

exercise in accordance with the established procedure control of state-owned property in subordinated state-financed organizations and the companies;

establish mass media.

The ministry of agricultural and water economy of the Republic of Uzbekistan has other rights, stipulated by the legislation.

10. Decisions and regulatory legal acts of the Ministry adopted within its competence are obligatory for execution by the ministries, departments, organizations, public authorities on places and business entities, irrespective of their patterns of ownership, and also officials and citizens.

IV. Councils on the problem resolution of development of industries and spheres of agricultural industry

11. In structure of central office of management of the Ministry of agricultural and water economy of the Republic of Uzbekistan Councils for the problem resolution are created:

developments of cotton growing;

grain-growing developments;

development and complex conversion of ovoshchebakhchevy cultures, fruits and grapes;

developments of livestock production;

rational use of land and water resources, development of irrigation and increase in fertility of lands;

mechanization and chemicalixation of agricultural industry.

Regulations on Councils affirm the minister of agricultural and water economy of the Republic of Uzbekistan.

12. The main objectives of Councils are:

development of specific recommendations about reforming and development of the corresponding industries, to effective use of potential of agricultural industry;

determination of the perspective directions of development of priority industries of agricultural industry, directions and ways of increase in their efficiency;

development of specific agrotechnological recommendations on perspective and for each agricultural year taking into account climatic, weather conditions and features of each region;

determination of priorities in selection and seed farming of crops, and also in breeding case;

development of recommendations about implementation of modern resource-saving technologies, to increase in fertility of the irrigated lands.

13. The leading experts and scientists having acknowledged authority on the respective areas of science and practice irrespective of the positions held by them and scientific ranks on a voluntary basis are part of Councils. The number and staff of Councils affirms board of the Ministry.

14. Chairmen of Councils are members of board of the Ministry of agricultural and water economy of the Republic of Uzbekistan and affirm the Cabinet of Ministers.

15. All recommendations of Councils are discussed at meetings of board of the Ministry of agricultural and water economy of the Republic of Uzbekistan which decisions are obligatory for execution.

16. Functions of working bodies of Councils are assigned to the relevant managements and departments of the Ministry of agricultural and water economy of the Republic of Uzbekistan.

V. Organization of activities of the Ministry

17. The ministry is headed by the Minister approved and dismissed by the President of the Republic of Uzbekistan.

The minister has five deputies, including one first, appointed and dismissed by the President of the Republic of Uzbekistan.

18. The deputy minister dealing with water management issues is at the same time the chief of Head department of water economy.

The CEO of the Uzbek research and production center of agricultural industry on position is deputy minister.

Deputy chief of Head department of water economy on the level of social and consumer services are equated to the deputy minister.

19. Minister:

directs activities of the Ministry and bears the personal responsibility for accomplishment of the tasks and obligations assigned to the Ministry;

in accordance with the established procedure approves the staff list of central office of the Ministry and has the right if necessary to make changes to the approved structure of central office of the Ministry and subordinated state-financed organizations within the established number of staff of workers and the salary fund;

in accordance with the established procedure appoints to position and dismisses employees of central office of the Ministry, heads of its territorial authorities, and also heads of jurisdictional enterprises, the organizations and organizations;

approves regulations on structural divisions of central office of the Ministry, regulations on Councils for problems of development of industries and spheres of agricultural industry, regulations on basin managements of irrigational systems, managements of the main channels (systems) and irrigational systems, and also provision (charters) of subordinated state-financed organizations;

issues orders, orders and the instructions obligatory for execution by employees of the Ministry, its territorial authorities and the subordinated organizations, will organize control of their execution;

cancels decisions (instruction) of territorial authorities and subordinated organizations accepted by them in violation of the law of the Republic of Uzbekistan.

performs other powers within the competence established by the legislation.

20. In the Ministry the board as a part of the Minister (the chairman of board), deputy ministers (on position), chairmen of Councils for the problem resolution of development of industries and spheres of agricultural industry, heads of separate divisions, the ministries and departments of system of agro-industrial complex, and also heads of the structural divisions of the ministry coordinating the main directions it activities is formed.

The number and staff of board affirm the Cabinet of Ministers of the Republic of Uzbekistan on representation of the Minister.

The board considers the questions connected with:

preparation and realization of the main activities of the Ministry determined in this Provision, of further carrying out the single agrotechnical policy directed to upgrade and sustainable development of agricultural industry, enhancement and implementation of modern agrotechnologies in the field of agricultural production, coordination of works on deepening of economic reforms in the agrarian sector, and also carrying out state policy in the field of selection and seed farming, breeding case and safety of products of livestock production, poultry farming and fish breeding, in use, protection, protection and development of forestry, to implementation of public administration by superficial water resources on the basis of the basin principle of management of irrigational systems and implementation at all levels of the market principles of water use and water consumption, and also to improvement of meliorative condition old irrigated and to development of new lands;

matching, arrangement, preparation and retraining of personnel to the positions entering the nomenclature of the Ministry of agricultural and water economy of the Republic of Uzbekistan;

strengthening of performing discipline on realization of the tasks determined in decrees, resolutions and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers of the Republic of Uzbekistan, increase in the personal responsibility of heads and employees of the Ministry for ensuring timely and their high-quality realization.

The board has the right to consider also and other questions which are within the competence of the Ministry.

Heads of other ministries, state committees, departments, public authorities on places, the companies, organizations, the organizations for the questions entering competence of the Ministry can be invited to meetings of board.

The board is authorized if at its meeting there is more than a half of its structure. Decisions on cases in point are made by a simple majority vote.

Decisions of board are implemented by orders of the Minister. In case of disagreements between the Minister and members of board the Minister independently makes the decision, reporting on the Cabinet of Ministers of the Republic of Uzbekistan on the arisen disagreements. Members of board can report the opinion to the Cabinet of Ministers of the Republic of Uzbekistan also.

The procedure for activities of board is determined by its regulations approved by board.

21. Territorial authorities of the Ministry are the Ministry of agricultural and water economy of the Republic of Karakalpakstan, regional managements and district departments of agricultural and water economy, basin managements of irrigational systems, managements of the main channels (systems) and management of irrigational systems.

22. Appointment of the minister of agricultural and water economy of the Republic of Karakalpakstan is performed by the Jokargi Kenes of the Republic of Karakalpakstan in coordination with the minister of agricultural and water economy of the Republic of Uzbekistan.

Appointment of heads of regional managements of agricultural and water economy is performed by the minister of agricultural and water economy of the Republic of Uzbekistan of representation of hokim of areas.

23. Appointment of heads of district departments of agricultural and water economy is performed by the minister of agricultural and water economy of the Republic of Karakalpakstan and chiefs of regional managements of agricultural and water economy of representation of hokim of areas.

24. Chiefs and deputy chief of basin managements of irrigational systems, heads of department of the main channels (systems) and irrigational systems are appointed to position by the minister on competitive basis.

The procedure for carrying out tender affirms the minister of agricultural and water economy of the Republic of Uzbekistan.

The ministry and its territorial authorities have the right to create expert and advisory bodies, provisions on which affirm respectively the minister or the head of territorial authority.

25. In the Ministry of agricultural and water economy of the Republic of Uzbekistan the Fund of social development and stimulation (further - Fund) which sources are assignments (in voluntary procedure) from self-supporting activities of the companies and organizations which are part of the Ministry including agricultural enterprises, on the basis of the signed agreements is in accordance with the established procedure created.

Fund is allocated for research, publishing works, content of central office of the Ministry of agricultural and water economy of the Republic of Uzbekistan, the Ministry of agricultural and water economy of the Republic of Karakalpakstan, regional managements and district departments of agricultural and water economy, the Center of projects implementation under the ministry.

The regulations on Fonda of social development and stimulation affirm the minister in coordination with the Ministry of Finance of the Republic of Uzbekistan.

26. Sources of financing of the Ministry of agricultural and water economy of the Republic of Uzbekistan, the Ministry of agricultural and water economy of the Republic of Karakalpakstan, regional managements and district departments of agricultural and water economy are budgetary appropriations and fund.

At the same time within budgetary appropriations expenses on salary payment and awards in the amount of one monthly salary, and are financed by Fund - award in the amount of one monthly salary and financial support in the amount of one monthly salary, and also other expenses.

27. Activities of the Ministry stop in the procedure established by the legislation.

Standard regulations on regional Management of agricultural and water economy

I. General provisions

1. Regional Management of agricultural and water economy (further - Management) is territorial authority of the Ministry of agricultural and water economy of the Republic of Uzbekistan and performs the tasks assigned to it and functions in the territory of the respective area.

organization of implementation of new advanced agrotechnologies of cultivation of crops;

rendering assistance in implementation of achievements of scientific research in the field of selection, seed farmings, breeding case, resource-saving and water saving technologies in production;

participation in investment attraction, monitoring of implementation of investment projects;

the organization of works on development in the village of production, social and market infrastructure;

preparation of offers on establishment of limits of water intake for agricultural water consumers on administrative areas and participation in control on their observance;

assistance in rational use of water resources, increase in their efficiency, implementation of the market principles and mechanisms of water use and water consumption, the organization of accounting of water resources by associations of water consumers, farmer and Dehkan farms, and also other water consumers for agricultural needs;

the organization of stimulation of associations of water consumers, farmer and Dehkan farms, and also other water consumers for agricultural needs for economical use of the limited water;

coordination of performance of works on operation of water management objects of associations of water consumers and measures for improvement of meliorative condition of the irrigated lands, and also on the organization of accounting of water use and water consumption, and also their development;

assistance in the organization, functioning and development of associations of water consumers in area;

coordination of activities of the regional inspections which are part of the Ministry of agricultural and water economy of the Republic of Uzbekistan to which control functions are assigned;

enhancement of work with personnel, organization of increase in their qualification.

6. According to the assigned tasks exercises Control the following functions:

gives methodical help to the companies of agricultural and water economy in the organization of productive and economic activity;

promotes farming development, develops offers on transformation of agricultural cooperatives (shirkat) to farms;

provides agricultural producers with information on market situation both other scientific and technical and information materials about advanced technologies, experience of production and conversion of agricultural products;

conducts monitoring of the conclusion and execution of agreements of contracting, develops, on the basis of generalization of the signed agreements, the offer on production volumes of main types of agricultural products;

carries out work on the organization of implementation of crop rotations, enhancement of the structure of sown areas, strain changing and sortorazmeshcheniye of crops, development of intensive soil-protective and water saving technologies;

will organize work on strengthening of food supply of livestock production, poultry farming and fish breeding, development of breeding case, veterinary science and services;

holds events for improvement of selection and breeding work, artificial insemination and performs their monitoring;

participates in work of Water management councils of basin irrigational systems;

makes offers in Basin management of irrigational systems on establishment of limits of water giving for agricultural water consumers on administrative areas;

helps and coordinates work on creation by associations by water consumers, farmer and Dehkan farms, and also other agricultural water consumers of contracts for water use and water consumption in general on area;

participates in development of offers and the organization of implementation of the market principles and mechanisms of water use and water consumption;

analyzes use of water resources and makes offers in Head department of water economy on stimulation of water users and water consumers for economical use of the limited water;

makes offers on development of associations of water consumers and assists in ensuring implementation of the adopted programs for their development, gives methodical and practical help on their organization and functioning;

conducts monitoring of activities of associations of water consumers, carrying out rescue and recovery operations on their water management objects and implementation of water saving technologies;

helps and coordinates work on equipment as water measuring installations of intraeconomic hydromeliorative systems;

develops offers on meliorative improvement and reconstruction of the irrigated lands and increase in fertility of soils;

studies requirement of the companies for specialists of agricultural and water economy, gives help in matching of rural youth for the direction for study, and also in their employment;

will organize work on implementation of the decisions of board of the Ministry of agricultural and water economy of the Republic of Uzbekistan accepted according to recommendations of Councils for effective use of potential of agricultural industry;

will organize advanced training of leading employees and specialists of the companies and organizations of agricultural and water economy, and also heads of farms;

gives practical help to district departments of agricultural and water economy in enhancement of work with personnel and in increase in their qualification.

III. Rights of management

7. Management has the following rights:

request and receive in accordance with the established procedure from the companies, organizations and the organizations the materials necessary for the solution of the questions entering its competence;

draw the conclusions on the drafts of decisions on use of land and water resources submitted to it for approval;

petition for involvement of perpetrators for violation of the land legislation to the corresponding responsibility;

has other rights, stipulated by the legislation.

8. The decisions of Management made within its competence are obligatory for execution of management by the relevant territorial authorities, business entities, and also officials and citizens.

IV. Organization of activities of Management

9. Management is headed by the chief appointed to position by the minister of agricultural and water economy of the Republic of Uzbekistan of representation of hokim of area.

10. Deputy heads of department are appointed to position by the minister of agricultural and water economy of the Republic of Uzbekistan of representation of hokim of area.

11. Head of department:

directs activities of management on the basis of one-man management and bears the personal responsibility for accomplishment of the tasks and obligations assigned to Management;

in accordance with the established procedure approves the staff list of the office of regional management and has the right if necessary to make changes to the approved structure within the established number of staff and the salary fund;

issues orders, instructs, obligatory for execution by employees of regional management and district departments of agricultural and water economy and the subordinated organizations, exercises control of their execution;

cancels decisions (instruction) of district departments of agricultural and water economy and the subordinated organizations accepted by them with violation of the law of the Republic of Uzbekistan.

12. Under Management Council as a part of the head of department (chairman of the board), his deputies who are part of Council for position, and also other highly-skilled employees is created. Council is formed as a part of 9 people. The staff of Council affirms the minister of agricultural and water economy of the Republic of Uzbekistan, decisions of Council are put into practice by orders of the head of department.

conducts general coordination of works on repair of intraeconomic hydromeliorative systems and to their development, and also implementation of water saving technologies;

together with inspection Uzsuvnazorat, and also in interaction with management of irrigational systems participates in control of observance of procedure for the limited water use and water consumption;

makes offers in regional management of agricultural and water economy on meliorative improvement of the irrigated lands;

performs information support and promotes implementation of achievements of science, agrotechnology, resources and water saving technologies;

promotes development and performs monitoring of activities of alternative machine and tractor parks;

will organize advanced training of heads and specialists of agricultural and water economy.
