About the technological documents regulating information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming and maintaining unified registers of the issued or accepted documents on assessment of conformity to requirements of technical regulations of the Eurasian Economic Union (technical regulations of the Customs union)" in the part concerning the unified register of the issued certificates of conformity and the registered declarations of conformity

According to Item 30 of the Protocol on information and communication technologies and information exchange within the Eurasian Economic Union (appendix №3 to the Agreement on the Eurasian Economic Union of May 29, 2014) and being guided by the Decision of Board of the Eurasian economic commission of November 6, 2014 №200, for the purpose of enhancement of mechanisms of forming and maintaining the unified register of the issued certificates of conformity and the registered declarations of conformity Board of the Eurasian Economic Commission decided:

Rules of information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming and maintaining unified registers of the issued or accepted documents on assessment of conformity to requirements of technical regulations of the Eurasian Economic Union (technical regulations of the Customs union)" in the part concerning the unified register of the issued certificates of conformity and the registered declarations of conformity;

Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union and the Eurasian economic commission in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming and maintaining unified registers of the issued or accepted documents on assessment of conformity to requirements of technical regulations of the Eurasian Economic Union (technical regulations of the Customs union)" in the part concerning the unified register of the issued certificates of conformity and the registered declarations of conformity;

Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming and maintaining unified registers of the issued or accepted documents on assessment of conformity to requirements of technical regulations of the Eurasian Economic Union (technical regulations of the Customs union)" in the part concerning the unified register of the issued certificates of conformity and the registered declarations of conformity;

The description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming and maintaining unified registers of the issued or accepted documents on assessment of conformity to requirements of technical regulations of the Eurasian Economic Union (technical regulations of the Customs union)" in the part concerning the unified register of the issued certificates of conformity and the registered declarations of conformity;

Procedure for accession to general process "Forming and maintaining unified registers of the issued or accepted documents on assessment of conformity to requirements of technical regulations of the Eurasian Economic Union (technical regulations of the Customs union)" in the part concerning the unified register of the issued certificates of conformity and the registered declarations of conformity.

2. Determine that development of technical schemes of structures of the electronic documents and data provided by the Description approved by this Decision, and ensuring their placement in the register of structures of the electronic documents and data used in case of realization of information exchange in the integrated information system of foreign and mutual trade are performed by department of the Eurasian economic commission which competence includes coordination of works on creation and development of the integrated information system of the Eurasian Economic Union.

3. This Decision becomes effective after 180 calendar days from the date of its official publication.

Rules of information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming and maintaining unified registers of the issued or accepted documents on assessment of conformity to requirements of technical regulations of the Eurasian Economic Union (technical regulations of the Customs union)" in the part concerning the unified register of the issued certificates of conformity and the registered declarations of conformity

I. General provisions

1. These rules are developed according to the following acts entering the right of the Eurasian Economic Union (further – the Union):

The agreement on the Eurasian Economic Union of May 29, 2014;

The decision of the Commission of the Customs union of June 18, 2010 No. 319 "About technical regulation in custom union";

The decision of the Commission of the Customs union of April 7, 2011 No. 620 "About the Single list of products which are subject to obligatory assessment (confirmation) of compliance within the Customs union with issue of single documents";

The decision of Board of the Eurasian economic commission of December 25, 2012 No. 293 "About single forms of the certificate of conformity and declaration of conformity to technical regulations of the Customs union and rules of their registration";

The decision of Board of the Eurasian economic commission of March 20, 2018 No. 41 "About the Order of registration, suspensions, renewals and cancellation of declarations of conformity of products to requirements of technical regulations of the Eurasian Economic Union";

The decision of Board of the Eurasian economic commission of September 26, 2017 No. 127 "About the Procedure for forming and maintaining the unified register of the issued certificates of conformity and the registered declarations of conformity";

The decision of Board of the Euroasian economic commission of November 6, 2014 №200 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general processes";

The decision of Board of the Eurasian economic commission of January 27, 2015 №5 "About approval of Rules of electronic data exchange in the integrated information system of foreign and mutual trade";

The decision of Board of the Euroasian economic commission of April 14, 2015 № 29 "About the list of general processes within the Eurasian Economic Union and modification of the Decision of Board of the Euroasian economic commission of August 19, 2014 № 132";

The decision of Board of the Euroasian economic commission of June 9, 2015 №63 "About the Analysis technique, optimization, harmonizations and descriptions of general processes within the Eurasian Economic Union";

The decision of Board of the Eurasian economic commission of September 28, 2015 № 125 "About approval of the Regulations on exchange of electronic documents in case of cross-border interaction of public authorities of state members of the Eurasian Economic Union among themselves and with the Eurasian economic commission".

II. Scope

2. These rules forming and maintaining unified registers of the issued or accepted documents on assessment of conformity to requirements of technical regulations of the Eurasian Economic Union (technical regulations of the Customs union)" in the part concerning the unified register of the issued certificates of conformity and the registered declarations of conformity (further respectively – general process, the unified register of certificates and declarations), including the description of the procedures performed within this general process are developed for the purpose of determination of procedure and conditions of information exchange between participants of general process ".

3. These rules are applied by participants of general process in case of control of procedure for performing procedures and transactions within general process, and also during the designing, development and completion of components of the information systems providing realization of general process.

III. Basic concepts

4. For the purposes of these rules concepts which mean the following are used:

"authorization" – provision to certain participant of general process of the rights to accomplishment of certain actions;

"the document on assessment of conformity" – the document confirming compliance of object of technical regulation to requirements of technical regulations of the Eurasian Economic Union (technical regulations of the Customs union), or the document issued (accepted) concerning products included in the single list of products which are subject to obligatory confirmation of conformity with issue of certificates of conformity and declarations

about compliance in single form;

"the unified register of the issued or accepted documents on assessment of conformity, the unified register" – general information resource which contains data on the issued or accepted documents on assessment of conformity. Forming and maintaining the unified register are performed by the Eurasian economic commission in electronic form with use of means of the integrated information system of the Union within interaction of state members of the Union and the Eurasian economic commission based on data from the national parts of the unified register represented to the Eurasian economic commission by authorized bodies of state members of the Union;

"the interested body of state member" – the state body (organization) of state member of the Union allocated according to the legislation of state member of the Union powers on realization of state policy in certain spheres and interested in receipt of urgent data about the issued or accepted documents on assessment of conformity for realization of the powers assigned to him, including requesting authorized body of state member of the Union;

"the requesting authorized body of state member" – the authorized body of state member of the Union receiving data about the issued or accepted documents on assessment of conformity from national part of the unified register of certificates and declarations of other state member of the Union;

"national part of the unified register" – the part of the unified register containing in information system of authorized body of state member of the Union which contains data on the issued or accepted documents on assessment of conformity. Forming and maintaining national parts of the unified register are provided with authorized bodies of state members of the Union according to the legislation of state members of the Union;

"authorized body of state member" – the state body (organization) of state member of the Union providing forming and maintaining national part of the unified register.

The concepts "group of procedures of general process", "information object of general process", "contractor", "transaction of general process", "procedure of general process" and "participant of general process" used in these rules are applied in the values determined by the Analysis technique, optimizations, the harmonization and the description of general processes within the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of June 9, 2015 № 63.

IV. Main data on general process

5. Full name of general process: "Forming and maintaining unified registers of the issued or accepted documents on assessment of conformity to requirements of technical regulations of the Eurasian Economic Union (technical regulations of the Customs union)". General process is implemented in the part concerning the unified register of certificates and declarations.

6. Specification symbol of general process: P.TS.01, version 2.0.0.

1. Purpose and tasks of general process

7. The purpose of general process is enhancement of mechanisms of forming and representation to participants of general process of data of unified registers of the issued or accepted documents on assessment of conformity.

8. For goal achievement of general process it is necessary to solve the following problems:

a) provide the Eurasian economic commission (further – the Commission) from authorized bodies of state members of the Union (further – state members) means of the integrated information system of the Union (further – the integrated system) data from national parts of unified registers of the issued or accepted documents on assessment of conformity and their publication on information portal of the Union;

b) provide possibility of receipt by interested persons of data on the issued or accepted documents on assessment of conformity on information portal of the Union;

c) provide the requesting authorized bodies of state members means of the integrated system of data on the issued or accepted documents on assessment of conformity from national parts of the unified register;

d) provide the means of the integrated system of data interested in bodies of state members on the issued or accepted documents on assessment of conformity from the unified register;

e) provide use by participants of general process of single qualifiers and reference books.

2. Participants of general process

9. The list of participants of general process is provided in table 1.

3. Structure of general process

10. General process represents set of the procedures grouped according to the destination:

a) procedures of forming and maintaining the unified register of certificates and declarations;

b) procedures of receipt of data from national part of the unified register of certificates and declarations;

c) procedures of receipt of data from the unified register of certificates and deklaratsiy.11. Within performing procedures of general process authorized bodies of state members perform forming and maintaining national parts of the unified register of certificates and declarations, represent data on documents on assessment of conformity from national parts of the unified register of certificates and declarations to the requesting authorized bodies of other state members, and also represent data from national parts of the unified register of certificates and declarations to the Commission. The commission processes the acquired information and provides publication of these data on information portal of the Union, and also provides submission of data from the unified register of certificates and declarations to the interested bodies of state members with means of the integrated system.

When forming and maintaining the unified register of certificates and declarations the following procedures of general process included in group of procedures of forming and maintaining the unified register of certificates and declarations are performed:

a) submission of data on updating of national part of the unified register of certificates and declarations;

b) updating of the statuses of documents with the expired effective period in the unified register of certificates and declarations.

Submission of the specified data is performed according to Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union and the Eurasian economic commission in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming and maintaining unified registers of the issued or accepted documents on assessment of conformity to requirements of technical regulations of the Eurasian Economic Union (technical regulations of the Customs union)" in the part concerning the unified register of the issued certificates of conformity and the registered declarations of conformity, the approved Decision of Board of the Eurasian economic commission of May 10, 2016 No. 39 (further – Regulations of information exchange between authorized bodies of state members and the Commission).

When obtaining by the requesting authorized body of state member of data on the document on assessment of conformity from national part of the unified register of certificates and declarations of other state member the "Receipt of Data from National Part of the Unified Register of Certificates and Declarations" procedure is performed (P.TS.01.PRC.002) included in group of procedures of receipt of data of national part of the unified register of certificates and declarations.

The request and submission of the specified data are performed according to Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming and maintaining unified registers of the issued or accepted documents on assessment of conformity to requirements of technical regulations of the Eurasian Economic Union (technical regulations of the Customs union)" in the part concerning the unified register of the issued certificates of conformity and the registered declarations of conformity, the approved Decision of Board of the Eurasian economic commission of May 10, 2016 No. 39 (further – Regulations of information exchange between authorized bodies of state members).

When obtaining by the interested body of state member of data from the unified register of certificates and declarations the following procedures of general process included in group of procedures of receipt of data of the unified register of certificates and declarations are performed:

a) receipt of data on date and time of updating of the unified register of certificates and declarations;

b) receipt of data from the unified register of certificates and declarations;

c) receipt of the changed data from the unified register of certificates and declarations.

The request and submission of the specified data are performed according to Regulations of information exchange between authorized bodies of state members and the Commission.

The format and structure of the data represented within performing procedures of general process shall match the Description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming and maintaining unified registers of the issued or accepted documents on assessment of conformity to requirements of technical regulations of the Eurasian Economic Union (technical regulations of the Customs union)" in the part concerning the unified register of the issued certificates of conformity and the registered declarations of conformity, to No. 39 approved by the Decision of Board of the Eurasian economic commission of May 10, 2016 (further – the Description of formats and structures of electronic documents and data).

Information exchange between authorized bodies of state members and the Commission, between authorized bodies of state members, and also between the interested bodies of state members and the Commission is performed with use of the integrated system. Access to data from the unified register of certificates and declarations for interested persons is performed through information portal of the Union.

12. The provided description of structure of general process is provided in the figure 1.

13. The procedure for performing procedures of general process, grouped according to the destination, including the disaggregated activity description, is given in the Section VIII of these rules.

14. For each group of procedures the general scheme showing bonds between procedures of general process and procedure for their accomplishment is provided. The general scheme of procedures is constructed with use of the graphical notation of UML (unified modeling language – Unified Modeling Language) and supplied with the text description.

4. Group of procedures of forming and maintaining the unified register of certificates and declarations

15. Procedures of forming and maintaining the unified register of certificates and declarations are carried out when updating national parts of the unified register of certificates and declarations, and also when updating the statuses of documents on assessment of conformity with the expired effective period, the certificates and declarations containing in the unified register.

In case of accomplishment of the "Submission of Data on Updating of National Part of the Unified Register of Certificates and Declarations" procedure (authorized bodies of state members represent P.TS.01.PRC.001) to the Commission of the data on the added and changed documents on assessment of conformity in national part of the unified register of certificates and declarations for the established period.

In case of accomplishment of the "Updating of the Statuses of Documents with the Expired Effective Period in the Unified Register of Certificates and Declarations" procedure (P.TS.01.PRC.003) the Commission performs forced change of the statuses of action of the certificates containing in the unified register and declarations of documents with the status "is effective" also with the expired effective period and notifies on it the authorized bodies of state members which directed the corresponding data from national part of the unified register of certificates and declarations within accomplishment of the "Submission of Data on Updating of National Part of the Unified Register of Certificates and Declarations" procedure (P.TS.01.PRC.001).

16. The provided description of group of procedures of forming and maintaining the unified register of certificates and declarations is provided in the figure 2.

5. Group of procedures of receipt of data of national part of the unified register of certificates and declarations

18. Procedures of receipt of data are carried out from national part of the unified register of certificates and declarations in case of receipt of the corresponding request from information system of the requesting authorized body of other state member.

19. The provided description of group of procedures of receipt of data of national part of the unified register of certificates and declarations is provided in the figure 3.

6. Group of procedures of receipt of data of the unified register of certificates and declarations

21. Procedures of receipt of data are carried out from the unified register of certificates and declarations in case of receipt of the corresponding request from information system of the interested body of state member.

Within performing procedures of receipt of data from the unified register of certificates and declarations the following types of requests are processed:

request of data on date and time of updating of the unified register of certificates and declarations;

request of data from the unified register of certificates and declarations;

request of the changed data from the unified register of certificates and declarations.

The request of data on date and time of updating of the unified register of certificates and declarations is carried out by the interested body of state member for the purpose of assessment of need of synchronization of the data on documents on assessment of conformity which are available in its information system with the data which are containing in the unified register of certificates and declarations and stored in the Commission. When implementing request the "Receipt of Data on Date and Time of Updating of the Unified Register of Certificates and Declarations" procedure is performed (P.TS.01.PRC.004).

The request of data is carried out from the unified register of certificates and declarations for the purpose of obtaining by the interested body of state member of data on the documents on assessment of conformity containing in the unified register of the certificates and declarations urgent for certain date (further – urgent data). Urgent data from the unified register of certificates and declarations can be requested both for current date, and as of the date specified in request.

Depending on request conditions urgent data from the unified register of certificates and declarations are represented according to the specific document on assessment of conformity which registration number is specified in request, or on document group about assessment of conformity, to answering one or more of the following conditions:

the status of action of the document on assessment of conformity corresponds to the status of action specified in request;

start date of effective period of the document on assessment of conformity is in the range of dates specified in request;

the country code, in national part of the unified register of certificates and which declarations the document on assessment of conformity is included matches with the country code specified in request;

the document type about assessment of conformity corresponds to the document type code about assessment of conformity specified in request;

designation of the technical regulation of the Union matches with the designation of the technical regulation of the Union specified in request.

When implementing request the "Receipt of Data from the Unified Register of Certificates and Declarations" procedure is performed (P.TS.01.PRC.005).

The request of the changed data is carried out from the unified register of certificates and declarations for the purpose of obtaining by the interested body of state member of the changed data on documents on assessment of conformity.

In case of request of the changed data from the unified register of certificates and declarations urgent data which were added to the unified register, and also urgent data to which changes during the period specified in request or since the moment specified in request until accomplishment of this request were made are represented. Depending on request conditions the changed data from the unified register are represented on specific state member, by the form the document on assessment of conformity and (or) on designation of the technical regulation of the Union.

When implementing request the "Receipt of the Changed Data from the Unified Register of Certificates and Declarations" procedure is performed (P.TS.01.PRC.006).

The specified procedures can consistently be performed (the "Receipt of Data on Date and Time of Updating of the Unified Register of Certificates and Declarations" procedure (P.TS.01.PRC.004), then the procedure "Receipt of the changed data from the unified register of certificates

and declarations" (P.TS.01.PRC.006)), or each procedure can separately be performed from others depending on the purposes of implementation of request.

22. The provided description of group of procedures of receipt of data of the unified register of certificates and declarations is provided in the figure 4.

VI. Responsibility of participants of general process

25. Attraction to disciplinary responsibility for non-compliance with the requirements aimed at providing timeliness and completeness of transfer of the data participating in information exchange of officials and staff of the Commission is performed according to the Agreement on the Eurasian Economic Union of May 29, 2014, other international treaties and acts constituting the right of the Union, and officials and the staff of authorized bodies of state members – according to the legislation of state members.
