ORDER OF THE MINISTER OF DEFENCE OF THE REPUBLIC OF KAZAKHSTAN

of December 14, 2017 No. 744

About approval of Rules of production of flights of the state aircraft of the Republic of Kazakhstan

(as amended on 19-06-2023)

According to the subitem 11) of article 15 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further – the Law) I ORDER:

1. Approve the enclosed Rules of production of flights of the state aircraft of the Republic of Kazakhstan.

2. To provide to management of the commander-in-chief Silami of air defense of Armed Forces of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan in paper and electronic types in the Kazakh and Russian languages within ten calendar days from the date of state registration;

3) placement of this order on Internet resource of the Ministry of Defence of the Republic of Kazakhstan after its first official publication;

4) the direction of data in Legal department of the Ministry of Defence of the Republic of Kazakhstan on execution of the actions provided by subitems 1), 2) and 3) of this Item within ten calendar days from the date of state registration.

3. To impose control of execution of this order on heads of governing bodies of the state aircraft of the Republic of Kazakhstan.

4. Bring this order to officials in the part concerning them.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of production of flights of the state aircraft of the Republic of Kazakhstan

Section 1. General provisions

1. Rules of production of flights of the state aircraft of the Republic of Kazakhstan (further - Rules) determine procedure for production of flights of the state aircraft of the Republic of Kazakhstan (further - the state aircraft).

2. The main determinations used in these rules:

1) air unit (further – part) – republican public institution, Aviation control of Air service of Committee of homeland security of the Republic of Kazakhstan the exercising production of flights of aircrafts (further – AF) destructive, bombing, attack, transport, army and educational state aircraft of the Republic of Kazakhstan, their operation, repair and storage, aviation commandant's offices, air stores parks, structural divisions of the Ministry of Defence of the Republic of Kazakhstan (further – MO RK), Services of the state protection of the Republic of Kazakhstan (further – SGO RK), the Ministries of Internal Affairs of the Republic of Kazakhstan (further – the Ministry of Internal Affairs of RK) and Committee of homeland security of the Republic of Kazakhstan (further – KNB RK) which include divisions the operating pilotless aircrafts (further – BVS), and also training centers on training of aviation personnel, training centers of combat training and fighting application of BVS;

2) the leading aircrew of air unit - the aircrew holding positions from the commander of aviation squadron, the chief of aviation department (further - the commander of aviation squadron) and above (in separate aviation squadron from the commander of link (group), the pilot of group (further - the commander of link (group)) and above);

3) aviation land specialists in servicing of the aircraft equipment - the aviation personnel having special preparation, performing activities for land ensuring flights of aircrafts, aviation works, maintenance of aircrafts, operation of land technical means of air traffic control, navigation, landing and communication, the organization and servicing of air traffic, air traffic control;

3-1) autogyro (гироплан) – the aircraft are heavier than air which is supported in flight due to air reactions, with one or several bearing screws freely rotating around the axes which are approximately in vertical position;

4) special aircrafts - AF, intended for accomplishment of tasks, with use of the special equipment installed on them;

5) the platform of purpose - specially prepared and designated platform providing working off of separate exercises by types of flight training;

6) special task - flight on task performance, not provided by Rates (programs) of combat, flight, educational and flight, special training approved as heads of governing bodies of the state aircraft (further - Rates);

Weeds 7) on devices – the flight which is carried out in conditions when space provision AF and its location is determined by crew fully or partially by flight and navigation devices or by means of pilotless aviation system;

8) the commander of AF – the pilot (pilot) who is the senior in crew and responsible for accomplishment and safety of flight of AF (further – KVS);

9) route of flight of AF - the projection of the set (established) trajectory of flight of AF to land (water) surface determined by the main turning points;

10) the senior aviation chief of airfield – the official from among commanders of air units (chiefs of aviation divisions) of the state aircraft, chiefs of the companies and the organizations of civil aviation which are based on this airfield appointed by governing body of the state aircraft (authorized body in the field of civil aviation) and organizing combat training (productive activity) in airfield;

11) the meteospecialist - the aviation land specialist having special preparation and holding the position connected with ensuring flights of aircrafts, operation, servicing and carrying out scheduled works on technical means of meteorological division;

12) control centers of air traffic (further – the Department of Internal Affairs centers) – the operational governing bodies of air traffic of Armed Forces of the Republic of Kazakhstan intended for planning and coordinating of use of airspace of the Republic of Kazakhstan, control over observance of procedure for use of airspace of the Republic of Kazakhstan, safety of flights and regularities of air traffic in the limits set for them regions of responsibility according to the Instruction for air traffic control of article 15 of the Law approved by authorized body in the field of the state aircraft according to the subitem 29);

13) route of servicing of air traffic - the established route which is intended for the direction of flow of movement for the purpose of ensuring servicing of air traffic (further - Department of Internal Affairs);

14) airfield circle of flights - the established route around airfield on which (or speak rapidly whom) ascent after take-off, decrease for landing approach, landing expectation, accomplishment of flight over airfield (airfield) is carried out;

15) extra airfield flight - is weeded by AF who is carried out outside the boundaries of airspace of the area of airfield with transfer of management to other governing body of air traffic with landing in airfield of take-off;

16) airfield flight - is weeded by AF who is carried out in borders of airspace of the area of airfield of take-off;

17) controlled airspace - airspace of certain sizes within which air traffic control (dispatching servicing) is provided;

18) uncontrollable airspace - the airspace within which according to classification of airspace only flight and information servicing of air traffic is provided or air traffic control is absent;

19) the airfield unmarked - the site of land, water or other surface which is picked up by crew of AF in flight, AF, suitable for take off and landing;

20) the airfield designated - the site of land, water or other surface, the AF, in advance picked up and suitable for take off and landing, having the coordinates, marking if necessary equipped with controls and ensuring flights;

21) echeloning side - dispersion of AF at one height on the established intervals on distance or angular shift between their lines of way;

22) airfields of joint basing - airfields of civil and state aviation on which are based AF, belonging to the state, civil and experimental aviation;

23) vektoreniye (radar targeting) - ensuring navigation targeting of AF by means of specifying of certain rates on the basis of use of data of the radar;

24) particular case - the situation resulting from failure of the aircraft equipment or hit of AF in the conditions demanding from crew of accomplishment of non-standard actions for safety of AF, passengers and crew;

25) the area flat – the area with relative excesses of relief to 200 meters (further – m) in radius of 25 kilometers (further – km);

25-1) trenazhny preparation – process of acquisition, working off and enhancement of practical skills by crew (individually) in full their functional obligations on flight operation of AF of specific type;

26) approach - movement of the helicopter over the maneuvering area of airfield (airfield) within the range of heights allowing to use effect of the earth and at the speeds accepted for taxing;

27) fighting aircraft - AF, intended for accomplishment of fighting task;

28) wind shear - the raised gradient of speed and (or) the direction of wind in cases when they considerably change on rather small site of the atmosphere;

28-1) land station of management (further – NSU) – the element of pilotless aviation system including complex of land controls and communication of BVS providing accomplishment of flight;

29) aerobatics - accomplishment of AF of figures of complex pilotage in their combination. Besides, all types of the turned flight and accomplishment of figures with negative overloads belong to aerobatics. Aerobatics is carried out on high-maneuverable and maneuverable AF;

30) the end of run - the moment of achievement of AF on run of the speed of taxing determined by the Management (instruction) for the flight operation of AF, approved by the head of AF manufacturer (further - RLE) allowing to execute safe change the direction of movement;

31) technical structure - the aviation personnel having the special preparation and the holding positions connected with servicing, operation, storage and repair of the aircraft equipment;

32) echeloning longitudinal - dispersion of AF at one height on the established intervals on time or distance along the line of way;

33) transport and combat aircrafts - AF, intended for transportation of people, loads, fuels and lubricants and accomplishment of fighting task;

34) transport aircrafts - AF, intended for transportation of people, loads and fuels and lubricants;

35) complex pilotage – accomplishment by the aircraft of figures of pilotage with pitch corners more than 45 degrees (10 degrees) and with lists more than 60 degrees (30 degrees);

36) simple pilotage – accomplishment by the aircraft of figures of pilotage with pitch corners to 45 degrees (10 degrees) and with lists to 60 degrees (30 degrees);

37) pilotless aviation system (further – the BASS) – BVS and the related elements (including communication channels and components, managing BVS) which are necessary for safe and effective operation of BVS in airspace;

38) landing - the slowed-down movement of AF from height of the beginning of equalization (the beginning of braking in case of vertical landing) until contact of land, water or other surface and the end of run (engine drosselirovaniye after landing in case of vertical landing);

39) visibility landing - distance from which the beginning of strip of exact landing is found and identified (the place of exact landing - for helicopters) or landing strip fires from cabin of AF who is on decrease glide path;

40) the area hilly - the area with the crossed relief and relative excesses from 200 m to 500 m in radius of 25 km;

41) control center the state aircraft - the command post, command control office, the starting command post, Item of targeting of aircraft, temporary (auxiliary) control center, the air command post, the air Item of targeting of aircraft which is carrying out tasks on control of flights and management of AF in case of operational air traffic (further - control center);

42) visibility meteorological - the horizontal visibility determined by meteorological service by means of technical means or visually by visibility reference points;

43) navigation preparation - the type of flight training directed to training of pilots and navigators in conducting orientation in flight, to keeping of parameters of fighting (flight) procedure and route of flight with exit in the set point at the scheduled time;

44) educational aircrafts - AF, intended for training of aircrew in technology of piloting and air navigation;

45) educational and fighting aircrafts - AF, intended for training of aircrew in technology of piloting, air navigation, to fighting application and accomplishment of fighting tasks;

46) aeronautical fuel reserve - fuel reserve over settlement quantity for flight from airfield (airfield) of departure to airfield of appointment (airfield), necessary on case of change of the flight plan caused by the direction on reserve airfield (airfield), variation from the approved route, strengthening of speed of head wind and other circumstances;

47) transitional layer - the airspace between height of transition and echelon of transition, flights of AF in the mode of horizontal flight in transitional layer is not allowed;

48) transition height – the relative (absolute) height established around airfield for transfer of scale of pressure of the barometric altimeter into value of pressure of 760 millimeters of mercury (1013,25 of millibars / гектапаскаль (further – Mbar/GPA)) in case of set of the set echelon;

49) transition echelon - the lower safe echelon of flight in airfield for transfer of scale of pressure of the barometric altimeter from pressure of 760 millimeters of mercury (Mbar/GPA 1013,25) upon pressure of airfield or the minimum pressure specified to sea level;

50) pilotage - the maneuvers which are purposely carried out by AF characterized by change of its space provision and mode of flight. On complexity degree pilotage is subdivided on simple, difficult and the highest, and by quantity participating in it AF - on single and group;

51) starting time - period of time during which the crew of AF is allowed to carry out flight;

52) transportation - weeds AF for the purpose of delivery of passengers (troops) or loads (military equipment) from one airfield (platform) on another;

53) the area mountain - the area with the crossed relief and relative excesses of 500 m and more in radius of 25 km, and also the area with exceeding above sea level 2000 m and more;

54) formation flying - joint flight of two and more AF under control of one KVS which is in structure of group;

55) echeloning vertical - dispersion of AF on height on the established intervals;

56) the reduced minimum of vertical echeloning (Reduced Vertical Separation Minimum) - the interval of vertical echeloning applied in the range between echelons of 8850 m (FL290) and 12500 m (FL410) for echeloning of AF having the admission to flights using RVSM;

57) visibility vertical - the maximum distance from the Earth's surface to the level from which down verticals are visible objects on the land surface;

58) No. 530 is excluded according to the Order of the Minister of Defence of the Republic of Kazakhstan of 31.05.2023

59) the operator of BVS – the member of calculation manipulating BVS of extra airfield basing during its flight;

60) the pilot - the crew member of the aircraft allowed to accomplishment of functions on control of the aircraft;

60-1) pilot (pilot) - the operator of BVS – the crew member of BVS allowed to accomplishment of functions on management of BVS of airfield basing;

61) aircrew - pilots, navigators, onboard conductors, cadets (listeners) of flight educational institutions and other officials the performing functions in flight as a part of crew of AF;

62) flight change - the period of time determined by the planned table of flights during which flights are carried out;

63) flight work - the work which is carried out by aircrew on accomplishment of flight task;

64) the senior of flight change - the official, from among the leading aircrew of air unit, appointed to flight change for the organization, carrying out and control of flights;

65) duration of flight change - time counted from the moment of the beginning of take-off of the first and until the end of landing of the last AF according to the planned table of flights;

66) documents on flight training - the documents determining content, amount and the sequence of training, enhancement, specialization and maintenance of skills of aircrew by their preparation for flights day and night in different weather conditions;

67) flight procedure - relative positioning of AF, in case of the joint flight which is not connected with accomplishment of fighting task;

68) flight task - the task for flight from take-off before landing of the aircraft determined by the Rate or set to the pilot by the direct commander (chief) leading aircrew of air unit, governing body of air traffic, governing body of the state aircraft;

69) flight time - time from the beginning of running start of AF in case of take-off (separation from terrestrial or surface of the water in case of vertical take-off) before the end of run (release of landing strip) or contact of land (water) surface in case of vertical landing;

70) flight echelon - the surface of permanent atmospheric pressure carried to the established size of pressure of 760 millimeters of mercury (Mbar/GPA 1013,25) and remote from other such surfaces at size of the established pressure intervals;

70-1) calculation of BVS – staff to which fulfillment of duties on operation and servicing the BASS is entrusted;

71) management of flights - actions of group of management of flights and calculations of the control centers attracted on the flights aimed at providing completeness, timeliness and safety of accomplishment by crews of AF of flight tasks;

72) group of management of flights - the aviation land specialists and/or aircrew appointed by the commander of air unit, the chief of aviation management (further - the commander of air unit) (the head of governing body of the state aircraft, the commander of the Air Force) for carrying out flights (flights) for management (management, control) flights in zones of the responsibility;

73) visibility flight - visibility from cabin of AF in flight;

74) technology of piloting - the type of flight training directed to training of aircrew in take-off, landing, accomplishment of space maneuvers odinochno and as a part of group;

75) production of flights - process of coordinated actions of staff of air units in the order of preparation, carrying out and blamestorming session;

76) flight accomplishment – process of management of AF of movement in airspace performed by crews piloted and BVS;

77) objective control of flights - system of the events held by the commander (chief) allocated for complex use of all funds and data of objective control for the benefit of quality excellence of training of staff, increase in safety of flights and reliability of AF;

78) the organization of flights - the complex of the events held by commanders and headquarters of parts, including decision making on carrying out flights, problem definition on flights, planning of flights, preparation for flights of aircrew, faces of group of management of flights, AF, means of land providing common application and airfield, accomplishment of flights and blamestorming session;

79) the planned table of flights - the document of the established sample in which graphical and tekstualno are stated (are displayed) the decision of the commander on carrying out flights and task to the crews participating in them;

80) visibility on landing strip - distance within which the pilot of AF who is on the axial line of landing strip sees marking signs on the surfaces of landing strip or fires limiting landing strip or designating its axial line;

81) flight and tactical preparation - the type of flight training directed to training of aircrew in conducting combat operations (accomplishment of fighting tasks) odinochno as a part of division and part;

82) flight - the flight which is carried out by AF with landing in other airfield (platform);

83) take-off - the accelerated movement of AF from the moment of moving (the moment of department from surface in case of vertical take-off) to department from land (water) or artificial surface and ascent of 10 m (height of influence of the screen of surface in case of vertical take-off);

84) bumpiness – chaotic movement of AF when flying in the turbulent atmosphere:

bumpiness moderate – moderate change of provision and (or) absolute height of AF, but still providing positive control where indications of the accelerometer constitute 0,5 minus divisions 1, 0g in the center of gravity of AF, and in case of take off and landing, moderate bumpiness in case of plus 0,3 minus divisions 0, 4g;

bumpiness strong – sharp change of provision and (or) absolute height of AF where during the short periods of AF does not react to management, with characteristic changes of air speed, with the indications of the accelerometer exceeding 1.0g in the center of gravity of AF, and in case of take off and landing, with increments of overload is more plus 0, 4g);

85) border area - the part of the territory of the Republic of Kazakhstan adjoining borderland within the territory of administrative and territorial units;

86) border strip - the airspace adjoining overland Frontier of the Republic of Kazakhstan 25 km wide, and also over territorial waters 22.2 km wide (12 nautical miles);

87) the electronic flight tablet - the electronic information system for flight crew consisting of the equipment and the application programs and allowing it to use functions on storage, updating, display and data processing applied in case of the accomplishment of flight or obligations connected with flight.

3. Treat governing bodies of the state aircraft of the Republic of Kazakhstan:

1) Management of the commander-in-chief Silami of air defense of Armed Forces of the Republic of Kazakhstan - in MO RK'S aircraft;

2) the Main command of National guard of the Republic of Kazakhstan - in aircraft of law-enforcement bodies of the Republic of Kazakhstan;

3) Air service of KNB RK (further - the EXPERT of KNB) - in aircraft of bodies of homeland security.

4. The basis for professional activity of aircrew and group of management of flights are:

1) for pilots, navigators - the document (the diploma, the certificate) on the termination of special educational institutions;

2) for other aircrew and faces of group of management of flights - the order on the admission to flights (to management of flights) on the end of training according to rates of combat (special) training (programs of flight training);

3) the conclusion of medical examination about the validity to professional activity;

4) the flight book (the book of the head of flights) in which data on availability of necessary knowledge and skills, on implementation of professional activity are reflected.

5. The governing body of the state aircraft provides:

1) the understanding aviation personnel of language on which RLE are written of the Maintenance guide, developed by the AF developer and other documents which are connected with accomplishment by aviation personnel of the service duties and its powers or provides to servicing and repair of AF the operator of AF with the certified transfer of the above-stated technical literature;

2) possibility of conducting radio exchange and communication - KVS and crew members, according to the procedures containing in RLE, with aviation personnel, land services, including bodies of Department of Internal Affairs and representatives of authorized body of foreign state in English in case of accomplishment of the international flights.

Section 2. Procedure for production of flights of the state aircraft

Chapter 1. Preparation of flights

Paragraph 1. Classification of aircrafts and time frames in case of take off and landing on one landing strip.

6. Are subdivided by AF of the state aircraft on purpose on fighting, educational and fighting, transport, transport and combat, educational and special.

7. Classification of AF depending on the maximum take-off weight is reflected in appendix 1 to these rules.

8. Concerning AF, having category of the turbulence inherent to heavy aircrafts, in case of primary establishment of communication between such aircrafts and governing body of air traffic (further - the body of the Department of Internal Affairs) before departure or arrival, to signal AF adds the word "heavy".

9. The minimum time frames in case of take-off from one landing strip (further - the runway) are established:

1) for easy AF behind average and heavy aircrafts - 3 minutes;

2) for heavy AF for heavy, and also the average AF following heavy - 2 minutes;

3) in case of accomplishment of formation flyings - according to the methodical recommendations approved by the commander of part;

4) in all other cases - at least 1 minute.

10. The echeloning minimum, to equal 3 minutes, is applied to the "easy" or "average" AF who is flying up after "heavy" AF or the "easy" AF who is flying up after "average" AF if take-off is carried out:

1) from middle part of the same runway;

2) from middle part of the parallel runways located at distance less than 760 m one from another.

11. In case of the displaced runway threshold:

Between "easy" or "average" AF and "heavy" AF, and also between "easy" AF and "average" AF the echeloning minimum is applied to equal 2 minutes when using the runway with the displaced threshold in cases:

1) rise of "easy" or "average" AF follows landing of "heavy" AF and rise of "easy" AF follows landing of "average" AF;

2) landing of "easy" or "average" AF follows rise of "heavy" AF and landing of "easy" AF follows rise of "average" AF if it is expected that their settlement trajectories of flight will be crossed.

The minimum time frame between take off and landing of AF when flying from one runway and parallel runways, distance between which axes less than 760 m - 1 minute.

12. The minimum time frames when landing to one runway, are established:

1) for easy AF behind average and heavy aircrafts - 3 minutes;

2) for average and heavy AF behind heavy aircrafts - 2 minutes;

3) in all other cases - at least 1 minute.

Paragraph 2. Classification of flights

13. To destination flights are subdivided on:

1) fighting - for accomplishment of fighting tasks using aviation weapons of destruction or other tasks of fighting application of AF of the state aircraft on purpose;

2) special - for accomplishment of tasks on ensuring national security and territorial integrity of the state, protection of law and order and Frontier, in case of the announcement of emergency state or the special period;

3) transport - for transportation of passengers, loads, baggage and mailings;

4) search and rescue, rescue and for delivery of health care to the population (including, in case of natural disasters of natural and technogenic nature);

5) educational:

export - flights for development of practical skills and abilities at aircrew of the technology of piloting, navigation and fighting application of AF providing successful development by them;

control - for check of aircrew to accomplishment of training flights;

training - for working off of the acquired flight skills and their further enhancement;

test - flights for determination of readiness of aircrew for accomplishment of tasks by types of flight and tactical training;

6) flights of land radio engineering means - for check and setup of radio engineering means of location, navigation and communication, land landing systems;

7) flights of AF (fact-finding, control flights) - for check in flight of work of systems and aggregates AF and power plants;

8) reracing flight - flight for the purpose of transfer of AF from the aircraft repair company (air repair unit, base) in air unit or back, and also from one air unit in another;

9) demonstration - for display of the aircraft and parachute equipment, promotion of achievements of aircraft, and also for the purpose of holding mass and political, sporting and cultural events.

14. By quantity of AF flights are subdivided on single and group.

15. On accomplishment height flights are subdivided:

1) at extremely small heights - from 0 to 200 m (inclusive) over land relief or surface of the water;

2) at small heights - is higher than 200 m also to 1000 m (inclusive) over land relief or surface of the water;

3) at average heights - is higher than 1000 m also to 4000 m (inclusive) from sea level;

4) at big heights - is higher than 4000 m also to 12000 m (inclusive) from sea level;

5) in stratosphere - is higher than 12000 m from sea level.

16. On physiographic conditions flights are subdivided:

1) over the plain and the hilly area;

2) over the mountain area;

3) over the bezoriyentirny and desert area and over surface of the water;

4) in polar regions of Northern and Southern hemispheres.

17. On time of day flights are subdivided:

1) day, carried out during the period between rising and sunset;

2) night, carried out during the period between calling and sunrise;

3) mixed in case of which accomplishment, during the period from take-off before landing of AF there is transition from day flight to night or on the contrary;

4) with crossing of 4 time zones and more.

Paragraph 3. Weather conditions of flights

18. Weather conditions in them are divided by degree of complexity of accomplishment of flight on simple and difficult.

Simple weather conditions (further - PMU) - conditions under which all flight is carried out visually (except visual flight under clouds in case of low cloudiness or limited flight visibility).

Difficult weather conditions (further - SMU) - conditions under which flight is fully or partially carried out on devices (in the absence of visibility of the earth or the natural horizon) or visually under clouds in case of low cloudiness or limited flight visibility.

The maximum and boundary parameter values of meteoelements in case of which flights are considered executed in SMU and minimum of weather are given in appendix of 2 these rules.

Flights belong to flights in SMU:

in clouds, between layers of clouds, behind clouds in case of cloudiness of 7 points and more;

in case of the maximum parameter values of meteoelements in case of which flights under clouds or the worsened visibility are considered executed in SMU according to the table 1 of appendix 2 to these rules;

over water spaces and without orient the area in the absence of visibility of the natural horizon (coastal line), and also in stratosphere.

19. Boundary parameters of meteoelements, less which flights are considered executed in minimum of weather are specified in the table 2 of appendix 2 to these rules. Paragraph 4. Air traffic management

20. Air traffic in airspace of the Republic of Kazakhstan is subdivided into general and operational.

21. 24. Management of operational air traffic is within the competence of bodies of the Department of Internal Affairs or group of management of flights from air unit.

25. The decision on reference of specific flight of AF of the state aircraft to operational air traffic is made by the main center Department of Internal Affairs (further - HZ of the Department of Internal Affairs) or the Department of Internal Affairs center by determination (appointment) of control centers, introduction of the temporary modes or short-term restrictions of use of airspace.

26. Flights of AF in case of operational air traffic are performed according to these rules.

27. Servicing of air traffic of AF of civil aviation, and also single flights and flights of military transport and (or) transport AF of the state aircraft in areas of airfields of joint basing is performed by duty shift of body (service) of Department of Internal Affairs.

The features of servicing of air traffic (air traffic control) connected with implementation of the simultaneous mixed general and operational air traffic in areas of airfields of joint basing of civil and state aviation are determined according to the Rules of use of airfields of joint basing of civil and state aviation of the Republic of Kazakhstan approved by the joint order of the Minister of Transport and Communications of the Republic of Kazakhstan of February 25, 2011 No. 91 and the Minister of Defence of the Republic of Kazakhstan of March 18, 2011 No. 128 (it is registered in the Register of state registration of regulatory legal acts for No. 6922) (further - Rules of use of airfields of joint basing of civil and state aviation of the Republic of Kazakhstan).

Paragraph 5. Instrument flight rules

28. The instrument flight rules (further - PPP) provide:

1) piloting of AF on flight and navigation devices;

2) providing with body of the Department of Internal Affairs of the established echeloning intervals between aircrafts.

29. Flights on PPP are applied:

1) in the lower region of flight information;

2) in the upper region of flight information;

3) when flying using blinds and other similar devices.

30. When flying on PPP the crew of AF conducts permanent observation of air and meteorological situation with use of onboard flight navigation equipment and visually.

31. KVS in case of accomplishment of flight on PPP:

1) carries out the schemes of take-off, exit (entrance) established in documents of aeronautical information from the area (to the area) airfield and landing approach;

2) maintains the echelons (heights) and route of flight, trajectory and parameters of flight established in documents of aeronautical information and appointed by body of servicing of air traffic (air traffic control);

3) is provided by informing body of the Department of Internal Affairs for its request on the actual location of AF, height and flight conditions;

4) follows instructions of body of the Department of Internal Affairs.

32. Transition from flights on devices to visual flights is performed by crews of AF in coordination with body of the Department of Internal Affairs. The body of the Department of Internal Affairs is not allowed to force crew of AF to carry out flights on PVP without its consent.

33. For the purpose of regulation of intervals between aircrafts by body of the Department of Internal Affairs the vektoreniye is made, and also are instructed in keeping of the modes of forward and vertical speeds in limits, admissible for this AF.

34. The personnel performing the Department of Internal Affairs the aircraft which is carrying out flight on PPP:

1) AF appoints echelon (height) of flight;

2) provides the established echeloning intervals;

3) exercises control of keeping of AF of route of flight, the scheme of exit (entrance) from the area of airfield, decrease and landing approach in the presence of radar control;

4) provides timely and reliable information to crew of AF about air, meteorological and ornithological situation, about variations from the set flight trajectory in the presence of radar control;

5) transfers flight conditions to crews of AF.

34-1. The strip of accounting of exceeding of land relief and artificial obstacles in it when calculating safe flight altitude around airfield out of the scheme of departure (landing approach) is established: in the afternoon - on 5 km, at night - on 10 km in both parties from route axis.

34-2. When flying according to the scheme of departure (landing approach) the strip of accounting of obstacles is established on 5 km in both parties from route axis.

34-3. When flying out of airways width of strip of accounting of exceeding of land relief and artificial obstacles day and night - on 25 km in both parties from flight route axis.

34-4. When flying in the afternoon in the flat or hilly area with the actual and predicted height of the lower bound of clouds it is not lower than 150 m also of visibility of 3000 m and more for AF with instrument speed of flight no more than 300 km/h height of artificial obstacles is not considered.

35. KVS, when flying on PPP, maintains the set flight mode, informs body of the Department of Internal Affairs on the actual location of the aircraft, the mode of flight and weather conditions of flight.

36. In the presence around flight of the aircraft of other aircrafts which create threat of dangerous rapprochement the body of the Department of Internal Affairs resolves flight on PVP only after receipt of the report of the commander of the aircraft on visual observation of these aircrafts.

Paragraph 6. Visual flight rules

37. The visual flight rules provide:

1) keeping of the established intervals between aircrafts by visual observation by crew of AF of flights of other AF;

2) determination of space provision AF and its location by the pilot (pilot) visually on the natural horizon and terrestrial (surface) reference points;

3) when flying at heights below the lower safe echelon keeping of true safe height and bypass of artificial obstacles visual observation of the area located ahead;

4) keeping of route, the scheme of flight by means of visual orientation and with use of the available flight navigation aids.

38. Flights on PVP are carried out at height of clouds at least than 50 m lower than the lower bound in the flat and hilly area and on 100 m at least - in the mountain area.

39. Flights on PVP are carried out with the maximum discretion of crew of AF.

40. It is allowed to bypass the obstacles observed ahead at the rate of AF and exceeding height of its flight, on the right on removal from obstacles at least 500 m.

41. Overtaking ahead of the flying AF at one height is carried out on the right, and when flying around - from outer side with observance of intervals of side echeloning.

Overtaking of AF following ahead at the same height in case of visual flights is not allowed at night.

42. When flying AF on the crossed rates on the same echelon (height) the crew which noticed another AF at the left reduces, and noticed on the right increases flight altitude so that the difference of heights provided safe discrepancy of AF.

If it is impossible to change height, KVS (pilot) carries out top of the AF for discrepancy the left boards to the right.

In the course of discrepancy pilots (pilots) need not to lose sight of another AF.

43. In cases when in case of accomplishment of flight task weather conditions become below the established minimum on PVP, crew of AF who is carrying out flight under control of body of the Department of Internal Affairs requests permission to accomplishment of special flight on PVP or on accomplishment of flight according to PPP.

44. The personnel of control center of aircraft exercising control of AF who is carrying out flight on PVP in controlled airspace:

1) AF appoints echelon (height) of flight;

2) is controlled by observance of time frames in case of rise of AF;

3) provides timely and reliable information, to crew of AF about air, meteorological and ornithological situation;

4) AF appoints safe echelon (height) and provides the established echeloning intervals between aircrafts upon transition to flight on PPP.

45. In case of deterioration in meteoconditions to the values non-compliant to the requirements for accomplishment of flight on PVP, special flights on PVP are provided day and night, in the presence of permission of Department of Internal Affairs relevant organ in the region (zone) of responsibility of which flights are carried out.

Body of the Department of Internal Affairs in the region (zone) of responsibility of which flights are carried out, informs crew of AF on deterioration in meteoconditions to the values non-compliant to the requirements for accomplishment of flight on PVP.

46. Special flights on PVP are carried out in case of accomplishment of urgent flights on servicing of the organizations of health care, when carrying out search and rescue and wrecking, in case of accomplishment of flights for the benefit of MO RK, Ministry of Internal Affairs of RK, KNB RK.

The minimum visibility for visual flights of helicopters is given to the table 2 of appendix 4 to these rules.

The minimum weather conditions and the minimum inventories of heights over obstacle for special flight are determined by PVP according to the table 3 of appendix 4 to these rules.

51. The minimum intervals of longitudinal echeloning between the aircrafts going along one route and on one echelon (height) - 2 km.

At the time of crossing of echelon (height) of the flight occupied with other AF and also crossing of route of flight on one echelon (height):

1) 2 km for AF with speeds of flight of 300 km/h and less;

2) 5 km for AF with speeds of flight more than 300 km/h.

52. The minimum intervals of side echeloning when flying at one height:

1) for divorced routes when flying along routes of Department of Internal Affairs is lower than the lower echelon - 5 km. The term "route of Department of Internal Affairs" is used for designation in appropriate cases of the airway, supervised or uncontrollable route, route of arrival or departure and other routes;

2) when overtaking ahead of the flying AF on the right (on airfield circle - from outer side) - 500 m.

Paragraph 8. Vertical, longitudinal and side echeloning in controlled airspace

53. When flying on PPP the following minimum intervals of vertical echeloning are applied:

1) on echelons of flight is lower than 8850 m (FL290) - 300 m (1000 feet);

2) between echelons of flight of 8850 m (FL290) and 12500 m (FL410):

300 m (1000 feet) - between AF, allowed to flights with RVSM;

600 m (2000 feet):

between the state AF who is not allowed to flights with RVSM and to other AF who is carrying out flight in RVSM airspace;

between all state AF who is carrying out flight as a part of group in airspace of RVSM and other AF;

in transition airspace from (k) RVSM between AF, not allowed to flights with RVSM and other AF;

between AF who is carrying out flight with the refused radio communication and any other AF when both AF carry out flight in RVSM airspace;

3) on echelons of flight is higher than 12500 m (FL 410) - 600 m (2000 feet).

54. When flying below the lower echelon the vertical distance between the lower echelon and flight altitude is established at least 300 m.

At heights below the lower echelon flights of AF on PVP with speeds no more than 300 km/h are echeloned through 150 m, with speeds more than 300 km/h - in all cases through 300 m.

55. The vertical distance between flight altitude around and the lower echelon of the waiting area shall be at least 300 m.

56. The vertical distance between aircrafts around airfield is established at least 300 m. For airplanes with landing speed less than 169 km/h and the helicopters which are carrying out flight on PVP below the lower echelon in places of crossing with routes of flights of AF with landing speed more than 169 km/h in case of radar control and longitudinal distance between them at least 5 km, the vertical interval is established at least 150 m.

57. It is not allowed to appoint at the same time same echelon (height) for flights of AF on PVP and PPP.

58. Vertical echeloning in airspace of the Republic of Kazakhstan is performed on semi-circular system:

1) in case of the direction of airways and routes with true traveling corners from 0 to 179 echelons of flights are (inclusive) established: 900 m, 1500 m (FL50), 2150 m (FL70), 2750 m (FL90), 3350 m (FL110), 3950 m (FL130), 4550 m (FL150), 5200 m (FL170), 5800 m (FL190), 6400 m (FL210), 7000 m (FL230), 7600 m (FL250), 8250 m (FL270), 8850 m (FL290), 9450 m (FL310), 10050 m (FL330), 10650 m (FL350), 11300 m (FL370), 11900 m (FL390), 12500 m (FL410), 13700 m (FL 450), 14950 m (FL 490);

2) in case of the direction of airways and routes with true traveling corners from 180 to 359 ° echelons of flights are (inclusive) established: 1200 m, 1850 m (FL60), 2450 m (FL80), 3050 m (FL100), 3650 m (FL 120), 4250 m (FL140), 4900 m (FL160), 5500 m (FL180), 6100 m (FL200), 6700 m (FL220), 7300 m (FL240), 7900 m (FL260), 8550 m (FL 280), 9150 m (FL300), 9750 m (FL320), 10350 m (FL340), 10950 m (FL360), 11600 m (FL380), 12200 m (FL400), 13100 m (FL430), 14350 m (FL 470).

59. Purpose of echelon (height) of flight by bodies of the Department of Internal Affairs is performed:

1) on transition echelon (the lower safe echelon) and above in numbers of echelon (for fighting aircraft, or at the request of crew of any AF appoints the corresponding echelon of flight in meters);

2) below transition echelon (the lower safe echelon) - in meters.

60. When changing echelon on turning point of route, because of change of the general direction of flight, occupation of new echelon is carried out for 20 km before flight of the specified Item of the obligatory report, on permission of bodies of the Department of Internal Affairs.

61. If the set true traveling corners of the majority of sections of the route (route) are in limits of one semicircle, and certain sites - within another, then for all airway (route) single echelons on condition of observance of security measures of flight are established.

62. Around airfield and in waiting areas vertical echeloning is made irrespective of the set traveling angles of flight.

Paragraph 9. The minimum intervals of longitudinal echeloning when flying on PPP with radar control

63. The minimum intervals of longitudinal echeloning when flying on PPP with radar control between the aircrafts going along one route on one echelon (height) constitute:

1) on airways and along routes of-30 km;

2) on airways and along routes when using automatic systems of the Department of Internal Affairs (further - the EXPERT of the Department of Internal Affairs) - 20 km;

3) in the approach area - 20 km;

4) in the approach area when using the EXPERT of the Department of Internal Affairs - 12 km;

5) in zone of take off and landing:

for all AF following aircrafts with take-off weight of 136 tons and more - 12 km;

for the easy AF following average aircrafts - 10 km;

in all other cases - 5 km.

64. When crossing the counter echelon (height) occupied with other AF - 30 km at the time of crossing (with observance of 10 km of side interval).

65. When crossing the passing echelon (height) occupied with other AF - 20 km, and in the approach area when using the EXPERT of the Department of Internal Affairs - 12 km at the time of crossing.

66. Between the aircrafts going along the crossed routes on one echelon (height) - 40 km at the time of crossing.

Paragraph 10. The minimum time frames of longitudinal echeloning on PPP in the absence of radar control

67. Time frames between the aircrafts going along one route and on one echelon (height):

1) along routes of Department of Internal Affairs and in the approach area - 10 minutes;

2) in case of accomplishment of maneuver according to the scheme of landing approach in zone of take off and landing - 3 minutes.
