About approval of the Procedure for execution of settlement and reporting documents when implementing sale of travel and carriage documents on rail transport

According to item 4 of Article 9 of the Section II of the Law of Ukraine "About application of registrars of settlement transactions in the field of trade, public catering and services", subitem 4.4.7 of subitem 4.4 of item 4 of the Regulations on the Ministry of infrastructure of Ukraine approved by the Presidential decree of Ukraine of May 12, 2011 No. 581, and for the purpose of reduction of regulatory legal acts in compliance with the legislation of Ukraine we ORDER:

1. Approve the Procedure for execution of settlement and reporting documents when implementing sale of travel and carriage documents on rail transport which is applied.

2. To provide to public administration of rail transport of Ukraine provision of this order on state registration in the Ministry of Justice of Ukraine in the procedure established by the legislation.

3. This order becomes effective from the date of its official publication.

4. Declare invalid:

the order of the Ministry of Transport and Communications of Ukraine, State Tax Administration of Ukraine of December 18, 2009 No. 1318/717 "About approval of Changes to the Procedure for execution of settlement and reporting documents when implementing sale of travel and carriage documents on rail transport", registered in the Ministry of Justice of Ukraine on March 15, 2010 for No. 217/17512.

Procedure for execution of settlement and reporting documents when implementing sale of travel and carriage documents on rail transport

I. General provisions

1.1. This Procedure determines the mechanism of accounting of settlement transactions when implementing sale of travel and carriage documents on rail transport, and also establishes requirements to blank forms of travel and carriage documents on rail transport.

1.2. In this Procedure references to such regulatory legal acts are given:

The law of Ukraine "About electronic documents and electronic document management";

The agreement on the international railway passenger traffic (further - SMPS);

The staff instruction to the Agreement on the international railway passenger traffic (further - the SI of SMPS);

The agreement on the international railway freight traffic (further - SMVD);

Convention on the international railway recarts (KOTIF);

The rules of transportation of passengers, baggage, cargo baggage and mail railway transport of Ukraine approved by the order of the Ministry of Transport and Communications of Ukraine of December 27, 2006 No. 1196, registered in the Ministry of Justice of Ukraine on April 04, 2007 for No. 310/13577 (with changes) (further - Rules of transportation of passengers);

The rules of transportation of loads approved by the order of the Ministry of transport of Ukraine of November 21, 2000 No. 644, registered in the Ministry of Justice of Ukraine on November 24, 2000 for No. 861/5082 (with changes);

The procedure for application of the electronic carriage document during transportation of loads by rail approved by the order of the Ministry of Transport and Communications of Ukraine of November 01, 2010 No. 800, registered in the Ministry of Justice of Ukraine on April 18, 2011 for No. 478/19216.

1.3. This Procedure is obligatory for the companies, organizations and the organizations (their structural divisions) of rail transport performing execution of travel and carriage documents in case of provision of services to passengers and freight owners and also for the organizations performing these transactions under agreements.

1.4. In this Procedure terms are used in such values:

the automated control system (further - ACS) - system which based on computer facilities of modern engineering procedures provides single process of automation of technological functions selling travel and carriage documents provides registration of other services which are provided by the companies, organizations and the organizations (their structural divisions) of rail transport;

baggage - things and other material values which go the passenger at additional expense in the presence of travel documents in the luggage car going in the same direction as the passenger;

load - material values which are transported by rail transport in the freight railway vehicles which are specially intended for this purpose;

cargo baggage - load which is transported in passenger and post and luggage trains;

the electronic document for return - the electronic document created by means of hardware and software system on registration/return of electronic travel (transportation) documents for ensuring passenger traffic (further - PAK EPD PP) which is confirmation of accomplishment of transaction on return of means for the unused electronic travel (transportation) document;

the electronic document for services - the electronic document created with the help PAK EPD PP who is confirmation of transaction of the order of services;

the electronic travel (transportation) document - the electronic document created according to the Law of Ukraine "About electronic documents and electronic document management" with the help PAK EPD PP who is the transportation agreement of the passenger (baggage);

the electronic carriage document on transportation of goods - set of the electronic documents determined by the Law of Ukraine "About electronic documents and electronic document management" in which information in the form of electronic data is fixed including obligatory details of the document and which can be created, transferred, kept and transformed by electronic means to visual form (display of data which it contains, electronic means or on paper in the form suitable for acceptance of its content by the person);

the international connection - transportation of passengers, loads, cargo baggage, baggage and mail between Ukraine and other states;

the predostavitel of services in sale/return of electronic travel/transportable documents - the company of rail transport public which falls within the scope of management of the Ministry of infrastructure of Ukraine has right to sell of travel and carriage documents according to constituent documents, technical capabilities and means for creation and implementation of electronic travel and carriage documents and signed the relevant agreements with carriers;

the hardware and software system on execution of electronic travel and carriage documents (PAK EPD PP) - hardware and software system, one of the main functions of which is registration/return of electronic travel (transportation) documents for ensuring passenger traffic;

the landing document - visual form of the electronic travel document or its part on the paper or electronic medium of information (the mobile phone, the smartphone, the tablet, the compact personal computer, the chip card and so forth) which contains unique code and unique number of the electronic travel document from which information is read out by the corresponding device or is entered in the corresponding sheet in the established form;

the travel document - the settlement document of the established form which is drawn up on the corresponding form of the travel document or created this Procedure and the current legislation, in electronic form according to requirements, certifying the conclusion of the contract between the railroad and the passenger on the drive and issued to the passenger after payment of the cost of this service by it;
