RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

About realization during the heating season of 2023-2024 of the pilot project on rendering additional support to the population on acquisition of solid oven household fuel

For the purpose of introduction in the conditions of warlike situation of additional support to the population on acquisition of solid oven household fuel the Cabinet of Ministers of Ukraine decides:

1. Agree with the offer of the Ministry of social policy concerning realization during the heating season of 2023-2024 of the pilot project on rendering additional support to the population on acquisition of solid oven household fuel (further - the pilot project).

2. Approve the Procedure for realization during the heating season of 2023-2024 of the pilot project on rendering additional support to the population on acquisition of the enclosed solid oven household fuel.

3. Determine that:

1) coordinator of the pilot project is the Ministry of social policy;

2) participants of the pilot project are:

as subjects of the request for administrative service and receivers of additional support to the population on acquisition of solid oven household fuel in heating season of 2023-2024 of Ukraine, foreigners and stateless persons which on legal causes are in the territory of Ukraine; persons having the right to privileges according to the laws of Ukraine "About the status and social protection of the citizens who were injured owing to the Chernobyl catastrophic crash", "About recovery of victims of repressions of communist totalitarian regime of 1917-1991", "About social and legal protection of the military personnel and members of their families" (except the military personnel), "About the Security Service of Ukraine", "About the status of veterans of war, guarantees of their social protection", "About the basic principles of social protection of veterans of work and other citizens of advanced age in Ukraine", "About the status of veterans of military service, law-enforcement bodies, veterans of National police and some other persons and their social protection", "About libraries and library science", "About the museums and museum case", "About protection of plants", "About the victims of Nazi prosecutions", "About child care", "About social protection of children of war", "About culture", "About education", "About recovery of the rights of persons, deported on national sign", the Code of civil protection of Ukraine (except faces of the private and the commanding structure), Bases of the legislation of Ukraine on health protection (further - exempts), and members of their families to whom the privilege (the wife (husband), their minor children extends (up to 18 years); the unmarried full age children recognized as persons with disability since the childhood of I and II groups or persons with disability of the I group; the person who is living together with person with disability owing to war of the I group and looking after her provided that person owing to war is not married to disability; disabled parents; person which is under guardianship or custody of the citizen having the right to privileges, and living together with it), living in premises (houses), do not receive utility on delivery of heat energy for centralized heating (heat supply) and do not use natural gas or electrical energy for individual heating and which during 2023-2024 addressed to bodies of the Pension fund of Ukraine behind provision of additional support to the population on acquisition of solid oven household fuel, and also citizens of Ukraine, foreigners and stateless persons who on legal causes are in the territory of Ukraine, exempts and members of their families to whom privileges and which acquired the right to payment of housing subsidy or privilege for acquisition of solid oven household fuel or received the corresponding payment in 2023 (further - receivers of privileges / housing subsidies) extend;

as are responsible for the organization and ensuring implementation of the pilot project - the Ministry of social policy and the Pension fund of Ukraine;

3) sources of financing of the pilot project are means of the government budget, and also means of other sources which are not prohibited by the legislation, in particular such which are used with the consent of the governments of foreign states, the international organizations, donor organizations.

4. Determine that:

1) payment of additional support to receivers of privileges / housing subsidies for acquisition of solid oven household fuel is performed within the pilot project taking into account procedure for establishment of bonus right or housing subsidy for acquisition of solid oven household fuel to the citizens who addressed for the corresponding type of the state support determined by the Regulations on procedure for purpose of housing subsidies approved by the resolution of the Cabinet of Ministers of Ukraine of October 21, 1995 No. 848 "About simplification of procedure for provision to the population of subsidies for expense recovery for payment of housing and communal services, acquisition of the liquefied gas, solid and liquid oven household fuel" (ZP of Ukraine, 1996, No. 2, Art. 76; Official Bulletin of Ukraine, 2000, No. 5, Art. 178; 2019, No. 69, the Art. 2390), Procedure for provision of privileges for payment of housing and communal services, acquisition of solid fuel and the liquefied gas in cash, the approved resolution of the Cabinet of Ministers of Ukraine of April 17, 2019 No. 373 "Some questions of provision of housing subsidies and privileges for payment of housing and communal services, acquisition of solid fuel and the liquefied gas in cash" (The Official Bulletin of Ukraine, 2019, No. 36, Art. 1263; 2020, No. 3, the Art. 161), and also taking into account the size added according to resolutions of the Cabinet of Ministers of Ukraine of April 23, 2012 No. 356 "About establishment of the minimum regulations of providing the population with solid and liquid oven household fuel and the liquefied limiting gas of indicators of their cost for provision of privileges and housing subsidies" (the Official Bulletin of Ukraine, 2012, No. 34, Art. 1268; 2020, No. 23, the Art. 869), of July 27, 1998 No. 1156 "About the new size of expenses on payment of housing and communal services, acquisition of the liquefied gas, solid and liquid oven household fuel in case of provision of housing subsidy" (The Official Bulletin of Ukraine, 1998, No. 30, Art. 1129; 2000, No. 5, the Art. 178) and taking into account the paid according to the resolution of the Cabinet of Ministers of Ukraine of April 23, 2012 to No. 356 "About establishment of the minimum regulations of providing the population with solid and liquid oven household fuel and the liquefied gas and limiting indicators of their cost for provision of privileges and housing subsidies" (The Official Bulletin of Ukraine, 2012, No. 34, Art. 1268; 2020, No. 23, the Art. 869) privileges and housing subsidies for acquisition of solid oven household fuel to their receivers at the expense of means of the government budget in heating season 2023-2024 (further - additional support);

2) the amount of the got additional support does not join in calculation of the total monthly (annual) taxable income;

3) in case additional support in heating season of 2023-2024 was performed to receivers of privileges / housing subsidies at the expense of means of the governments of foreign states, the international organizations, donor organizations in the amount of, equal or exceeding the difference size between the amount of the added privileges or housing subsidies for acquisition of solid oven household fuel intended using the minimum regulations of providing the population with solid fuel and limiting cost indexes of solid fuel determined by Item 5 of this resolution, and the amount of the added and paid privileges / housing subsidies for acquisition of solid fuel intended using the minimum regulations of providing the population with solid fuel and limiting cost indexes of solid fuel according to the resolution of the Cabinet of Ministers of Ukraine of April 23, 2012 No. 356 "About establishment of the minimum regulations of providing the population with solid and liquid oven household fuel and the liquefied gas and limiting indicators of their cost for provision of privileges and housing subsidies" (The Official Bulletin of Ukraine, 2012, No. 34, Art. 1268; 2020, No. 23, by the Art. 869) in 2023-2024, additional support in heating season of 2023-2024 according to the pilot project to such receivers of privileges / housing subsidies are not performed;

4) in case additional support in heating season of 2023-2024 was performed to receivers of privileges / housing subsidies at the expense of means of the governments of foreign states, the international organizations, donor organizations in the amount of, smaller established, the half-received amount of means in this payable period is paid to such receivers at the expense of budgetary funds according to the Procedure approved by this resolution;

5) sales terms of the pilot project and questions of exchange of information for implementation of additional support which is performed at the expense of means of the governments of foreign states, the international organizations, donor organizations are determined by the Memorandum of understanding between the financing party (further - partners), both the Ministry of social policy and the Pension fund of Ukraine. The regulations that the personal data of exempts, members of their families, receivers of housing subsidies received from the Pension fund of Ukraine, are used by the governments of foreign states, the international organizations, donor organizations with which the specified Memorandum is concluded only for implementation of payment of additional support and its monitoring shall be the compulsory provision of the specified memorandum;

6) the procedure for information exchange is determined by the technical protocol between the Pension fund of Ukraine and partners;

7) collection, registration, accumulating, use, storage and implementation of other actions with personal data of receivers of privileges / housing subsidies to which additional support is provided in particular with use of the information (automated) systems, is performed with observance of requirements of the Laws of Ukraine "About information" and "About personal data protection".

5. Determine that during effective period of the pilot project:

1) rendering additional support to the population on acquisition of solid oven household fuel according to the pilot project is performed on the following regulations:

the minimum regulations of providing the population with solid oven household fuel for provision of privileges amounts of solid fuel which can allocate 12064500 Kcal of heat (which can approximate be received from 6,22 of ton of svezhesrublenny wood with the level of humidity of 50 percent or 1,87 of ton of coal presented at the market of Ukraine);

the minimum regulations of providing the population with solid oven household fuel for provision of housing subsidies amounts of solid fuel which can allocate 14367096 Kcal of heat for household in year (which can approximate be received from 7,41 of ton of svezhesrublenny wood with the level of humidity of 50 percent or 2,23 of ton of coal presented at the market of Ukraine);

2) such limiting cost index of solid oven household fuel - 0, 001129935 hryvnias for 1 Kcal is applied to support to the population on acquisition of solid oven household fuel in heating season of 2023-2024.

6. Additional support is performed for means of partners in case of provision by the receiver of privileges / housing subsidies on its own behalf and name of members of the family of such exempt to whom privileges, persons from structure of household of the receiver of housing subsidies and members of the family of persons from structure of household of receivers of housing subsidies whose income is considered in case of purpose of housing subsidy, the method determined by the Procedure approved by this resolution, to the Ministry of social policy or the Pension fund of Ukraine of consent to collection, transfer and processing of the personal data for the purpose of implementation of payment of additional support and carrying out its monitoring by partners extend.

The amount of additional support is determined as difference between the size of the added means of privileges / housing subsidies for acquisition of solid oven household fuel calculated taking into account the minimum regulations of providing with the solid oven household fuel and limiting indicator of its cost approved by this resolution, and the size of the added/paid means of privileges / housing subsidies for acquisition of solid oven household fuel calculated taking into account the minimum regulations of providing with solid oven household fuel and the limiting indicator of its cost approved according to the resolution of the Cabinet of Ministers of Ukraine of April 23, 2012 No. 356 "About establishment of the minimum regulations of providing the population with solid and liquid oven household fuel and the liquefied gas and limiting indicators of their cost for provision of privileges and housing subsidies" (The Official Bulletin of Ukraine, 2012, No. 34, Art. 1268; 2020, No. 23, Art. 869).

In case of lack of consent to collection, transfer and processing of the personal data for the purpose of implementation of payment and its monitoring by partners in the corresponding payable period (year) payment of additional support on acquisition of solid oven household fuel in heating season of 2023-2024 to such receivers of privileges / housing subsidies is performed at the expense of means of the government budget in the amount of payment of the state support, determined by the paragraph the second this Item.

In case of provision in heating season of 2023-2024 by partners of any other payment on acquisition of solid oven household fuel to the receiver of privileges / housing subsidies in the amount of at least 6660 hryvnias for each member of his family payment of additional support for the pilot project in heating season of 2023-2024 is not performed.

In case of carrying out in heating season of 2023-2024 by partners or for funds of the government budget of payment of additional support for acquisition of solid oven household fuel to receivers of privileges / housing subsidies in the amount of not smaller what it is determined by the paragraph the second this Item payment of additional support for the pilot project in heating season of 2023-2024 repeatedly is not performed.

7. Bring the enclosed changes in resolutions of the Cabinet of Ministers of Ukraine.

8. To provide to the pension fund of Ukraine:

1) in two weeks after entry into force of this resolution - calculation of the amount of additional support taking into account the privileges which are already provided in 2023 and housing subsidies to the population on acquisition of solid oven household fuel intended using the minimum regulations of providing the population with solid fuel and limiting cost indexes of solid fuel approved by the resolution of the Cabinet of Ministers of Ukraine of April 23, 2012 No. 356 "About establishment of the minimum regulations of providing the population with solid and liquid oven household fuel and the liquefied gas and limiting indicators of their cost for provision of privileges and housing subsidies";

2) during effective period of the pilot project - till January 20 and till May 20, 2024 to inform the Cabinet of Ministers of Ukraine on implementation of the pilot project.

9. To give to the ministry of social policy till July 1, 2024. To the Cabinet of Ministers of Ukraine the report on results of its realization and suggestion for improvement of the legislation in the field of provision of privileges and housing subsidies for acquisition of solid oven household fuel.

Procedure for realization during the heating season of 2023-2024 of the pilot project on rendering additional support to the population on acquisition of solid oven household fuel

1. This Procedure determines the realization mechanism during the heating season of 2023-2024 of the pilot project by rendering additional support to the population on acquisition of solid oven household fuel (further - the pilot project) taking into account duration of heating season from October 16 to April 15 inclusive.

2. In this Procedure terms are used in the following sense:

receivers of privileges / housing subsidies citizens of Ukraine, foreigners and stateless persons which on legal causes are in the territory of Ukraine; exempts and members of their families to whom privileges extend and which acquired the right to payment of housing subsidy or privilege for acquisition of solid oven household fuel or received the corresponding payment;

the partner governments of foreign states, and also the international organizations, donor organizations with which Minsotspolitiki and the Pension fund of Ukraine is imprisoned the Memorandum of understanding;

exempts - persons having the right to privileges according to the laws of Ukraine "About the status and social protection of the citizens who were injured owing to the Chernobyl catastrophic crash", "About recovery of victims of repressions of communist totalitarian regime of 1917-1991", "About social and legal protection of the military personnel and members of their families" (except the military personnel), "About the Security Service of Ukraine", "About the status of veterans of war, guarantees of their social protection", "About the basic principles of social protection of veterans of work and other citizens of advanced age in Ukraine", "About the status of veterans of military service, law-enforcement bodies, veterans of National police and some other persons and their social protection", "About libraries and library science", "About the museums and museum case", "About protection of plants", "About the victims of Nazi prosecutions", "About child care", "About social protection of children of war", "About culture", "About education", "About recovery of the rights of persons, deported on national sign", the Code of civil protection of Ukraine (except faces of the private and the commanding structure), Bases of the legislation of Ukraine on health protection.

3. The pension fund of Ukraine till November 20, 2023 informs means of mobile/electronic communication, in particular through the web portal of electronic services of the Pension fund of Ukraine, mobile application of the Pension fund of Ukraine, receivers of privileges / housing subsidies for acquisition of solid oven household fuel about need till December 1, 2023 by method, convenient for them, after the information message to address to bodies of the Pension fund of Ukraine for provision on its own behalf and name of members of the family of the exempt to whom the privilege, persons from structure of household of the receiver of housing subsidies and members of families of persons of structure of household of the receiver of housing subsidies which income is considered in case of purpose of housing subsidy, consent to collection extends, transfer and processing of the personal data (further - consent) for receipt of additional support by the population on acquisition of solid oven household fuel in heating season of 2023-2024 at the expense of means of partners by transfer to partners of the personal data for payment of additional support and its monitoring.

In case of provision by the receiver of privileges / housing subsidies on its own behalf and name of members of the family of such exempt to whom the privilege, persons from structure of household of the receiver of housing subsidies, members of the family of person from structure of household of the receiver of housing subsidies which income is considered in case of purpose of housing subsidy extends Minsotspolitiki or the Pension fund of Ukraine of consent for payment of any other monetary assistance from the international organizations, in particular within project implementation on implementation of additional measures of social support of separate categories of the population, in particular from among pensioners and/or internally displaced persons, provision of repeated consent by such receivers is optional, and collected personal data are used by the Pension fund of Ukraine, in particular such, which are received by secure channels of communication from the state company "data processing center of the Ministry of social policy of Ukraine", for further use for the purpose of implementation of payments and their monitoring by partners in case of implementation of the pilot project without additional informing.

4. The pension fund of Ukraine by results of the additional support received from receivers of privileges / housing subsidies of consent for provision till December 5, 2023 transfers to partners the available information on such receivers necessary for carrying out payment of additional support to such receivers of privileges / housing subsidies for expense recovery for acquisition of solid oven household fuel, with indication of the amount of such payments for each receiver determined according to the paragraph to the second Item 6 of the Resolution of the Cabinet of Ministers of Ukraine of November 7, 2023 No. 1173 "About realization during the heating season of 2023-2024 of the pilot project by rendering additional support to the population on acquisition of solid oven household fuel".

5. After receipt from the Pension fund of Ukraine of information on receivers of privileges / housing subsidies, payment, necessary for carrying out, partners till December 20 perform payment of additional support by money transfer on the bank account (according to the IBAN standard) in bank in which the account of the receiver is opened, or implementation of money transfers through international payment system of WESTERN UNION for the receiver receiving payment of privileges / housing subsidies through department of the organization performing payment and delivery of pensions and the monetary assistance in the place of the actual accommodation and within two working days provide to the Pension fund of Ukraine information on implementation of payment and the amount of such payment for each receiver specified in the register.

6. In case when additional support to receivers of privileges / housing subsidies for acquisition of solid oven household fuel was not paid by partners till December 20, 2023 (except the cases determined by paragraphs the fourth and fifth Item 6 of the Resolution of the Cabinet of Ministers of Ukraine of November 7, 2023 No. 1173 "About realization during the heating season of 2023-2024 of the pilot project by provision of additional support to the population on acquisition of solid oven household fuel") or the amount of its payment is less than the size, added by the Pension fund of Ukraine, information on which was transferred to partners according to item 4 of this Procedure, the Pension fund of Ukraine within five days from the date of receipt from partners of information on implementation of payment of additional support calculates the necessary amount of surcharge on each receiver, and also on receivers, specified in paragraph three of Item 6 of the Resolution of the Cabinet of Ministers of Ukraine of November 7, 2023 to No. 1173 "About realization during the heating season of 2023-2024 of the pilot project on rendering additional support to the population acquisition of solid oven household fuel", creates requirement of expenses of the government budget on financing of additional support and the need for expenses on fee in connection with their payment and delivery, includes it in the request concerning the need for budgetary funds for payment of privileges / housing subsidies and requirement for fee connected with payment and delivery of privileges / housing subsidies through department of the organization performing payment and delivery of pension and the monetary assistance and registers the corresponding budgetary obligations in bodies of Treasury.

Payment of additional support to receivers of privileges / housing subsidies is in that case performed in the next payable period by transfer by the Pension fund of Ukraine of funds for the account of the receiver of privilege / housing subsidy opened in authorized bank whether it is paid to it by cash through department of the organization performing payment and delivery of pensions and the monetary assistance in the place of the actual accommodation.

7. In case of receipt in body of the Pension fund of Ukraine during the period between December 1, 2023 and on March 15, 2024 statements for appointment and provision of housing subsidy in form according to appendix 1 to the Regulations on procedure for purpose of housing subsidies approved by the resolution of the Cabinet of Ministers of Ukraine of October 21, 1995 No. 848 "About simplification of procedure for provision to the population of subsidies for expense recovery for payment of housing and communal services, acquisition of the liquefied gas, solid and liquid oven household fuel" (ZP of Ukraine, 1996, No. 2, Art. 76; Official Bulletin of Ukraine, 2000, No. 5, Art. 178; 2019, No. 69, Art. 2390; 2022, No. 80, the Art. 4826), statements for provision of privileges for payment of housing and communal services, acquisition of solid fuel and the liquefied gas in form according to appendix to the Procedure for provision of privileges for payment of housing and communal services, acquisition of the solid fuel and the liquefied gas in cash approved by the resolution of the Cabinet of Ministers of Ukraine of April 17, 2019 No. 373 "Some questions of provision of housing subsidies and privileges for payment of housing and communal services, acquisition of solid fuel and the liquefied gas in cash" (the Official Bulletin of Ukraine, 2019, No. 36, Art. 1263; 2020, No. 3, Art. 161; 2022, No. 80, the Art. 4826), statements for appointment and provision of housing subsidy according to the pilot project in form according to appendix to the Procedure for implementation of the pilot project on enhancement of procedure for provision to the population of subsidies for expense recovery for payment of housing and communal services, acquisition of the liquefied gas, the solid and liquid oven household fuel approved by the resolution of the Cabinet of Ministers of Ukraine of June 13, 2023 No. 601 "About implementation of the pilot project on enhancement of procedure for provision to the population of subsidies for expense recovery for payment of housing and communal services, acquisition of the liquefied gas, solid and liquid oven household fuel" (The Official Bulletin of Ukraine, 2023, No. 60, the Art. 3388) which arrived from persons needing the state support on acquisition of solid fuel the body of the Pension fund of Ukraine studies such statements on provision of privilege or housing subsidy for solid fuel and based on the made decisions on purpose of housing subsidy or privilege performs the corresponding payments in general procedure according to the resolution of the Cabinet of Ministers of Ukraine of April 23, 2012 No. 356 "About establishment of the minimum regulations of providing the population with solid and liquid oven household fuel and the liquefied gas and limiting indicators of their cost for provision of privileges and housing subsidies" (The Official Bulletin of Ukraine, 2012, No. 34, Art. 1268; 2020, No. 3, the Art. 869) and no later than the 25th in which the decision on purpose of housing subsidy or privilege is made, transfers to partners information on such persons necessary for carrying out payment of additional support to such receivers of privileges / housing subsidies for expense recovery for acquisition of solid oven household fuel, with indication of the amount of such payments for each receiver determined according to the paragraph to the second Item 6 of the Resolution of the Cabinet of Ministers of Ukraine of November 7, 2023 No. 1173 "About realization during the heating season of 2023-2024 of the pilot project by rendering additional support to the population on acquisition of solid oven household fuel".

8. After receipt from the Pension fund of Ukraine of information on receivers of privileges / housing subsidies, payment, necessary for carrying out, which arrived during the period between December 5, 2023 and on March 5, 2024 partners till one month, but no later than April 5, 2024 perform payment of additional support by money transfer on the bank account (according to the IBAN standard) in bank in which the account of the receiver is opened, or implementation of money transfers through international payment system of WESTERN UNION for the receiver receiving payments of privileges / housing subsidies through department of the organization performing payment and delivery of pensions and the monetary assistance in the place of the actual accommodation and within two working days provide to the Pension fund of Ukraine information on implementation of payment and the amount of such payment for each receiver.

9. In case when additional support to receivers of privileges / housing subsidies for acquisition of solid oven household fuel was not paid by partners till April 5, 2024 (except the cases determined by paragraphs the fourth and fifth Item 6 of the resolution of the Cabinet of Ministers of Ukraine of November 7, 2023 No. 1173 "About realization during the heating season of 2023-2024 of the pilot project by provision of additional support to the population on acquisition of solid oven household fuel") or the amount of its payment is less than the size, added by the Pension fund of Ukraine, information on which was transferred to partners according to Item 7 of this Procedure, the Pension fund of Ukraine within five days from the date of receipt from partners of information on implementation of payment of additional support calculates the necessary amount of surcharge on each receiver, and also on receivers, specified in paragraph three of Item 6 of the Resolution of the Cabinet of Ministers of Ukraine of November 7, 2023 to No. 1173 "About realization during the heating season of 2023-2024 of the pilot project on provision of additional support to the population acquisition of solid oven household fuel", also performs the corresponding payment of additional support at the expense of means of the government budget according to Item 6 of this Procedure.

10. Additional support to receivers of privileges / housing subsidies for acquisition of solid oven household fuel according to this Procedure to receivers of privileges / housing subsidies can be performed no more once during effective period of the pilot project.

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine

1. In Regulations on the procedure for purpose of housing subsidies approved by the resolution of the Cabinet of Ministers of Ukraine of October 21, 1995 No. 848 "About simplification of procedure for provision to the population of subsidies for expense recovery for payment of housing and communal services, acquisition of the liquefied gas, solid and liquid oven household fuel" (ZP of Ukraine, 1996, No. 2, Art. 76; Official Bulletin of Ukraine, 2000, No. 5, Art. 178; 2019, No. 69, Art. 2390; 2022, No. 80, Art. 4826):

Item 60 to add 1) with the paragraph of the following content:

"Information on personal data of receivers of housing subsidies can be transferred for implementation of additional support to the international organizations, donor organizations with the consent of the applicant or his legal representative specified in the statement.";

Appendix 1 to the Provision to add 2) with the paragraph of the following content:

"In case of circumstances under which additional support on payment of housing and communal services, acquisition of solid oven household fuel at the expense of means of the governments of foreign states, the international organizations, donor organizations can be given me I provide the consent to transfer (in need of) my personal data and these persons from structure of household and members of families of persons of structure of household which income is considered in case of purpose of housing subsidy, the government of foreign states, to the international organizations, donor organizations for assistance and monitoring.".

2.
