About approval of Rules of marking of cameras (except movie cameras), flashlights and lamps flashes means of identification and the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning photogoods

The government of the Russian Federation decides:

1. Approve the enclosed Rules of marking of cameras (except movie cameras), flashlights and lamps flashes by means of identification.

2. Determine that participants of turnover of cameras (except movie cameras), flashlights and lamps flashes (further - photogoods) according to the Rules approved by this resolution:

a) are registered in the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further - information system of monitoring), till February 29, 2020 (inclusive) or after February 29, 2020 within 7 calendar days from the date of emergence of need of implementation by the participant of turnover of photogoods of the activities connected with input in turnover and (or) turnover, and (or) conclusion from turnover of photogoods;

b) provide in time, not exceeding 30 calendar days from the date of registration in information system of monitoring, readiness of own software and hardware for information exchange with information system of monitoring and send to the operator of information system of monitoring the request for passing of testing of information exchange;

c) send after registration in information system of monitoring to the operator of information system of monitoring the request for provision of remote access to the issue registration device placed in infrastructure of information system of monitoring, electronically;

d) pass test of information exchange of own software and hardware and information system of monitoring according to the procedure posted on the official site of the operator of information system of monitoring on the Internet concerning marking of photogoods, input of photogoods in the turnover, their turnover and conclusion from turnover according to the Rules approved by this resolution, in time which is not exceeding 60 calendar days from the date of readiness of own software and hardware for information exchange with information system of monitoring;

e) bring since October 1, 2020 according to the Rules approved by this resolution in information system of monitoring of the data on marking of photogoods, and also about their input in turnover, turnover and conclusion from turnover.

At the same time if participants of turnover of photogoods put funds of identification for consumer packaging or for the label of photogoods since day of entry into force of this resolution, from the specified date they have the right to enter into information system of monitoring of the data on drawing means of identification;

e) in the presence as of October 1, 2020 in the territory of the Russian Federation the unrealized photogoods made or imported on the territory of the Russian Federation till October 1, 2020 perform till December 1, 2020 their marking by means of identification and enter into information system of monitoring of the data on marking of such photogoods means of identification according to the Rules approved by this resolution;

g) till November 1, 2020 perform marking of the photogoods acquired till October 1, 2020 and issued by customs authorities after October 1, 2020 according to customs procedure of release for internal consumption to the offer of these photogoods for realization (sale) and enter into information system of monitoring of the data on marking of such photogoods means of identification according to the Rules approved by this resolution;

h) have the right to perform import to the territory of the Russian Federation and realization of the sets of goods and sets of goods imported on the territory of the Russian Federation which part photogoods are, without their marking by means of identification and not to enter into information system of monitoring of the data on such sets of goods and sets of goods according to the Rules approved by this resolution till October 1, 2022.

3. Determine that participants of turnover of photogoods have the right to put funds of identification for consumer packaging or for the label of the photogoods corresponding to codes under the All-Russian Product Classifier by types of economic activity (further - the qualifier) 26.70.12, 26.70.14, 26.70.17.110, 27.40.31 and to code of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union (further - the commodity nomenclature) 9006 (except 9006 91 000 0, 9006 99 000 0), from the date of entry into force of this resolution.

Drawing funds of identification for consumer packaging or on the label of the photogoods corresponding to codes on the qualifier 26.70.12, 26.70. 14, 26.70.17.110, 27.40.31 and to code of the commodity nomenclature 9006 (except 9006 91 000 0, 9006 99 000 0), is obligatory since October 1, 2020, except as specified, provided by this resolution.

4. Registration in information system in which information support of carrying out experiment according to the order of the Government of the Russian Federation of May 14, 2019 No. 589 "About carrying out in the territory of the Russian Federation experiment on marking by means of identification of cameras was performed (except movie cameras) of flashlights and lamps flashes", legal entities and individual entrepreneurs who as of November 30, 2019 were participants of experiment is equated to registration in information system of monitoring.

If the data entered into information system in which information support of carrying out experiment was performed within the specified experiment by participants of turnover of photogoods do not meet the requirements of the Rules approved by this resolution, participants of turnover of photogoods enter missing and (or) urgent data in information system of monitoring till February 29, 2020.

5. Determine that the operator of information system of monitoring provides:

a) provision to participants of turnover of photogoods of remote access to the issue registration devices placed in infrastructure of information system of monitoring, on the conditions provided by the Rules approved by this resolution, in time, not exceeding 90 calendar days from the date of obtaining from participants of turnover of photogoods of requests for receipt of remote access to them;

b) the organization of testing of information exchange of software and hardware of participants of turnover of photogoods and information system of monitoring in time, not exceeding 30 calendar days from the date of obtaining from participants of turnover of photogoods of the notification of the readiness of own software and hardware to information exchange with information system of monitoring;

c) provision to the participants of turnover of photogoods performing marking by means of identification of the photogoods introduced into circulation till October 1, 2020, codes of marking of remaining balance of the goods necessary for forming of means of identification since March 1, 2020;

d) provision to the participants of turnover of photogoods performing marking by means of identification of the photogoods introduced into circulation till October 1, 2020, the codes of marking necessary for forming of means of identification since March 1, 2020 on condition of entering into information system of monitoring of all data necessary for registration of the corresponding photogoods in information system of monitoring;

e) provision to the participants of turnover of photogoods performing marking by means of identification of the photogoods introduced into circulation after October 1, 2020, the codes of marking necessary for forming of means of identification on condition of entering into information system of monitoring of all data necessary for registration of the corresponding photogoods in information system of monitoring.

6. Determine that in the territory of the Russian Federation input in turnover of photogoods without drawing funds of identification for them and entering into information system of monitoring of data on marking of photogoods means of identification, and also turnover and conclusion from turnover of the photogoods which are not marked by means of identification specified in Item 3 of this resolution is allowed till October 1, 2020, except as specified, provided by subitems "e", "zh" and "z" of Item 2 of this resolution.

7. Restrictions, stipulated in Item 6 these resolutions, are not applied to photogoods on which according to the Rules approved by this resolution, and international treaties of the Russian Federation requirements about obligatory marking by means of identification do not extend.

8. Determine that the service fee on provision of codes of marking is levied from the date of entry into force of this resolution.

9. This resolution becomes effective from the date of its official publication.

I. General provisions

1. These rules determine procedure for marking of cameras (except movie cameras), the flashlights and lamps flashes which are subject to obligatory marking by means of identification (further - photogoods), requirements to participants of turnover of photogoods, procedure for information exchange of participants of turnover of the photogoods with the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification (further - information system of monitoring), characteristics of means of identification of photogoods, and also procedure for representation by participants of turnover of photogoods of data to the operator of system on input in turnover, turnover and conclusion from turnover of photogoods.

2. The concepts used in these rules mean the following:

"aggregation" - process of consolidation of photogoods in shipping package with drawing on the created shipping package of code of identification of shipping package;

"aggregative customs code" - the unique sequence of symbols for each separate set of goods representing consolidation of codes of identification of each goods, including codes of identification of the packaging combining goods in the course of aggregation, created by the operator of system for the purposes of identification of goods according to these rules, used by the participant of turnover of goods in case of customs declaration of goods;

in case of production of photogoods in the territory of the Russian Federation (including in cases of contract manufacturing), including cases of production of photogoods from the foreign raw materials placed under customs procedure of free customs zone or under customs procedure of free warehouse - primary paid or voluntary conveyance of photogoods from the producer to the new owner or the other person for the purpose of their alienation to such person or for the subsequent realization (sale, including retail) which makes photogoods available for distribution and (or) use;
